Y\u0131l, \u00f6zelle\u015ftirme ma\u011fduru i\u015f\u00e7ilerden olan TEKEL i\u015f\u00e7ilerinin \u201ck\u00f6lelik\u201d olarak tan\u0131mlad\u0131klar\u0131 ge\u00e7ici personel (kamuoyunun tercih etti\u011fi ad\u0131yla 4\/C) stat\u00fcs\u00fcne kar\u015f\u0131 verdikleri me\u015fru m\u00fccadele ile ba\u015flad\u0131, bug\u00fcnlerde ise, tekrarlanan \u201cac\u0131\u201d verici bir olay\/maden i\u015f\u00e7ilerinin \u00f6l\u00fcm\u00fc sebebiyle \u201cta\u015feron\u201d uygulamas\u0131n\u0131n tart\u0131\u015f\u0131lmas\u0131 ile devam ediyor. <\/p>\n<p>Asl\u0131na bak\u0131l\u0131rsa, her iki uygulama\/\u00e7al\u0131\u015fma ili\u015fkisi de ayn\u0131 d\u00fc\u015f\u00fcnce temeline dayal\u0131; \u00e7al\u0131\u015fanlar\u0131n gerek anayasal\/yasal gerekse de uluslararas\u0131 s\u00f6zle\u015fmeler ile kabul edilmi\u015f\/tan\u0131mlanm\u0131\u015f sosyal haklar\u0131n\u0131 \u201celden geldi\u011fince\u201d ortadan kald\u0131rma, b\u00f6ylelikle \u00e7al\u0131\u015fanlar\u0131 i\u015fveren\/devlet kar\u015f\u0131s\u0131nda g\u00fc\u00e7s\u00fcz k\u0131lma imkan\u0131 tan\u0131yan i\u015f ili\u015fkileri olu\u015fturmak..<\/p>\n<p>\u00c7o\u011fu firma, i\u015f\u00e7ilik giderlerini \u201cy\u00fcksek\u201d buldu\u011fundan, maliyet azaltmak i\u00e7in en kestirme yolu se\u00e7iyor; i\u015f\u00e7ilik giderlerini d\u0131\u015fsalla\u015ft\u0131rmak (outsourcing). Bu ama\u00e7la kurulmu\u015f, esas\u0131nda hukukumuzda tan\u0131mlanmam\u0131\u015f\/kabul edilmemi\u015f\/yasak olan \u201ci\u015f\u00e7i kiralama\u201d i\u015fi yapan firmalar ile alt i\u015fverenlik (ta\u015feronluk) s\u00f6zle\u015fmeleri imzalan\u0131yor. B\u00f6ylelikle esas i\u015fveren ba\u015fta i\u015f g\u00fcvenli\u011fi vb. yasal y\u00fck\u00fcml\u00fcl\u00fcklerden kurtularak maliyet azalt\u0131rken, di\u011fer yandan da i\u015fsizli\u011fin giderek artt\u0131\u011f\u0131 \u00fclkemizde \u201ci\u015fe ihtiya\u00e7 duyan\u201d geni\u015f bir kitleden g\u00f6nl\u00fcnce eleman se\u00e7en alt i\u015fveren firma, ba\u015fta \u00f6rg\u00fctlenme hakk\u0131 olmak \u00fczere \u00e7a\u011fda\u015f haklardan yararlanma imkan\u0131 hemen hemen yoksay\u0131lan i\u015f\u00e7ileri \u201casgari d\u00fczeydeki\u201d ko\u015fullarla \u00e7al\u0131\u015ft\u0131rabilme esnekli\u011fine kavu\u015fmaktad\u0131r.<br \/>\nTemel amac\u0131n i\u015f\u00e7ilik maliyetlerini azaltmak oldu\u011fu bir \u00e7al\u0131\u015fma ili\u015fkisinde de, bu bak\u0131\u015f a\u00e7\u0131s\u0131n\u0131n do\u011fal sonu\u00e7lar\u0131ndan birisi olan ac\u0131 olay\/kazalar\u0131 da \u201ckader\u201d diye savunmak d\u0131\u015f\u0131nda vicdan\u0131n\u0131z\u0131 rahatlatacak bir arg\u00fcman\u0131n\u0131z kalm\u0131yor&#8230;<\/p>\n<p>Benzer \u015fekilde, kamu personelinin yasalar ile belirlenmi\u015f \u201ci\u015f g\u00fcvencesi\u201d nedeniyle siyasi ama\u00e7lar\u0131n\u0131za uymayan personelden kurtulman\u0131n g\u00fc\u00e7l\u00fc\u011f\u00fc, kamu personelinin i\u00e7eri\u011fi yarg\u0131 i\u00e7tihatlar\u0131yla belirlenmi\u015f \u201ckariyer, liyakat\u201d gibi temel haklar\u0131n\u0131n varl\u0131\u011f\u0131, g\u00fcc\u00fcn\u00fc hissettirmeye ba\u015flayan kamu g\u00f6revlileri sendikalar\u0131 devleti aray\u0131\u015fa itmi\u015f ve her ne kadar istisnai olarak ve ba\u015fka ama\u00e7lar i\u00e7in \u00f6ng\u00f6r\u00fclm\u00fc\u015f olsa da, 657 say\u0131l\u0131 Devlet Memurlar\u0131 Yasas\u0131\u2019n\u0131n 4\/C bendinde tan\u0131mlanan \u201cge\u00e7ici personel\u201d uygulamas\u0131, uygun bir hukuki k\u0131l\u0131f gibi g\u00f6r\u00fcnm\u00fc\u015ft\u00fcr. Bu modelde, devlet, bir i\u015fveren olarak, \u00f6rg\u00fctlenme hakk\u0131 ba\u015fta olmak \u00fczere pek \u00e7ok hukuki korumadan yoksun bir \u00e7al\u0131\u015fan kitlesine sahip olmu\u015ftur.<br \/>\nTEKEL i\u015f\u00e7ilerinin eylemi ile yap\u0131lan de\u011fi\u015fikliklere kadar, 4\/C\u2019li ge\u00e7ici personelin sendikal\u0131 olma hakk\u0131 tan\u0131nmad\u0131\u011f\u0131 gibi, k\u0131dem tazminat\u0131\/emekli ikramiyesi\/i\u015f sonu tazminat\u0131 alma hakk\u0131 da kabul edilmemi\u015f, y\u0131ll\u0131k izin s\u00fcreleri i\u015f\u00e7i\/memura g\u00f6re son derece d\u00fc\u015f\u00fck belirlenmi\u015ftir. Her y\u0131l yenilenen s\u00f6zle\u015fme kavram\u0131 ile, \u00e7al\u0131\u015fan\u0131n i\u015fteki gelece\u011fi amirlerinin takdirine b\u0131rak\u0131lm\u0131\u015f, \u00e7o\u011fu kurumda, anayasadaki \u201cangarya yasa\u011f\u0131na\u201d ra\u011fmen, fazla \u00e7al\u0131\u015fma \u00fccreti verilmeksizin \u00e7al\u0131\u015ft\u0131r\u0131lmas\u0131 \u00f6ng\u00f6r\u00fclm\u00fc\u015f, kimi kurumlarda y\u0131llarca s\u00fcren \u00e7al\u0131\u015fmaya ra\u011fmen hi\u00e7bir mesleki kariyer\/y\u00fckselme imkan\u0131 tan\u0131nmam\u0131\u015f, her y\u0131l en alt d\u00fczeyden \u00fccret almaya zorlanm\u0131\u015f, deyim yerindeyse, bu \u00e7a\u011fda, ba\u015fka hi\u00e7bir yerde g\u00f6remeyece\u011finiz, bu nedenle de eylem s\u00fcrecinde 4\/C\u2019li \u00e7al\u0131\u015fma ko\u015fullar\u0131n\u0131 \u00f6\u011frenen \u00e7o\u011fu gazetecenin \u201caaaa!!!!\u201d nidas\u0131na sebep olan bir \u00e7al\u0131\u015fma ili\u015fkisi&#8230;<br \/>\nZenginli\u011fin artt\u0131\u011f\u0131 bir d\u00f6nemde, \u00e7al\u0131\u015fan ve \u00e7al\u0131\u015famayan (i\u015fsizler) kesimin ya\u015fam \u015fartlar\u0131n\u0131n giderek a\u011f\u0131rla\u015fmas\u0131\/zorla\u015fmas\u0131, elbette, iddia edilenin aksine bir zorunluluk de\u011fil, gelirin b\u00f6l\u00fc\u015f\u00fcm\u00fcnde  yap\u0131lan bilin\u00e7li bir se\u00e7imin sonucudur. Siyasi iktidar, kendisini\/etraf\u0131n\u0131 zenginle\u015ftirme hedefi koymu\u015fsa \u00f6n\u00fcne, bu, siyasi g\u00fc\u00e7ten yoksun kesimlerin fakirle\u015fmesi ile ula\u015f\u0131labilecek bir hedeftir ancak&#8230;<\/p>\n<p>B\u00f6ylesi bir s\u00fcrecin sonunda, kurulu\u015fundan bu yana 4\/C \u00e7al\u0131\u015fma ili\u015fkisinin yasaya ayk\u0131r\u0131l\u0131\u011f\u0131 konusunda ciddi m\u00fccadele veren, en ba\u015fta \u00f6rg\u00fctlenme hakk\u0131n\u0131n tan\u0131nmas\u0131 i\u00e7in 4\/C\u2019li personeli sendikaya \u00fcye yapabilmek i\u00e7in hukuki s\u00fcre\u00e7 ba\u015flatan HAKSEN Konfederasyonun \u00e7abalar\u0131 ile TEKEL i\u015f\u00e7ilerinin eylemleri sonu\u00e7 vermi\u015f ve HAKSEN\u2019e \u00fcye olan ge\u00e7ici personel Sabahattin G\u00fcrler ad\u0131na \u201ck\u0131dem tazminat\u0131\u201d istemi ile a\u00e7\u0131lan davada, Dan\u0131\u015ftay \u0130dari Dava Daireleri Kurulu 18.03.2010 tarihli karar\u0131 ile, yasal d\u00fczenlemenin Anayasaya ayk\u0131r\u0131 oldu\u011fu gerek\u00e7esiyle Anayasa Mahkemesine ba\u015fvuru karar\u0131 alm\u0131\u015ft\u0131r.<br \/>\nKararda, Dan\u0131\u015ftay,<\/p>\n<p>&#8230; devlete \u00e7al\u0131\u015fanlar\u0131 korumak, \u00e7al\u0131\u015fma bar\u0131\u015f\u0131n\u0131 sa\u011flamak i\u00e7in tedbir alma y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fcn\u00fc getiren Anayasan\u0131n 49.maddesi, Anayasan\u0131n 2. maddesinde ifadesini bulan &#8220;Sosyal Hukuk Devleti&#8221; ve &#8220;Hukuk G\u00fcvenli\u011fi&#8221; ilkeleri; istihdam \u015fekilleri belirlenerek \u00e7al\u0131\u015fma hayat\u0131n\u0131n yasayla d\u00fczenlenmesini zorunlu k\u0131lmaktad\u0131r. Elbette temel bir insan hakk\u0131 olan \u00e7al\u0131\u015fma hakk\u0131na ili\u015fkin yasalarda, \u00e7al\u0131\u015fma hakk\u0131n\u0131 fonksiyonel k\u0131lacak yeterli d\u00fczenlemelere yer verilmesi; s\u0131n\u0131rlamalar\u0131n da, Anayasan\u0131n 13. maddesine uygun bi\u00e7imde, hakk\u0131n \u00f6z\u00fcne dokunulmadan, \u00f6l\u00e7\u00fcl\u00fcl\u00fck ilkesine uygun yap\u0131lmas\u0131 gerekir.<\/p>\n<p>\u00c7al\u0131\u015fma hakk\u0131n\u0131n varl\u0131\u011f\u0131, yeterli \u00f6l\u00e7\u00fcde i\u015f g\u00fcvencesi ve sosyal g\u00fcvenlik hakk\u0131 tan\u0131nmas\u0131na ba\u011fl\u0131d\u0131r. Haks\u0131z, keyfi i\u015ften \u00e7\u0131karmaya kar\u015f\u0131 hukuki korumay\u0131 ifade eden i\u015f g\u00fcvencesi ve sosyal g\u00fcvenlik hakk\u0131n\u0131 d\u00fczenlemeyen bir yasan\u0131n, \u00e7al\u0131\u015fma hakk\u0131n\u0131 korudu\u011fundan s\u00f6z etmeye olanak bulunmamaktad\u0131r. \u0130\u015f g\u00fcvencesi ve sosyal g\u00fcvenlik hakk\u0131n\u0131 tan\u0131yan, istihdam \u015fekillerini yeterli bi\u00e7imde tan\u0131mlay\u0131p, d\u00fczenleyen yasal d\u00fczenlemelerle \u00e7al\u0131\u015fma hakk\u0131 korunabilir&#8230;<\/p>\n<p>diyerek, \u00e7al\u0131\u015fma ili\u015fkisine dair koruyucu h\u00fck\u00fcmleri ve ba\u011flant\u0131y\u0131 ortaya koymu\u015f, arkas\u0131ndan da,<br \/>\nAnayasa&#8217;n\u0131n 2. maddesinde ifadesini bulan ve Anayasa Mahkemesi&#8217;nin yerle\u015fik kararlar\u0131na g\u00f6re, g\u00fc\u00e7s\u00fczleri g\u00fc\u00e7l\u00fcler kar\u015f\u0131s\u0131nda koruyarak ger\u00e7ek e\u015fitli\u011fi, yani sosyal Devlet niteli\u011fiyle, Devletin temel ama\u00e7 ve g\u00f6revlerini belirleyen 5. maddesindeki&#8221;&#8230;ki\u015finin temel hak ve h\u00fcrriyetlerini, sosyal hukuk devleti ve adalet ilkeleriyle ba\u011fda\u015fmayacak surette s\u0131n\u0131rlayan siyasal, ekonomik ve sosyal engelleri kald\u0131rma&#8230;&#8221; kural\u0131yla, &#8220;\u00c7al\u0131\u015fma hakk\u0131 ve \u00f6devi&#8221; ba\u015fl\u0131\u011f\u0131 alt\u0131ndaki 49. maddesinin ikinci f\u0131kras\u0131nda vurgulanan &#8220;Devlet,&#8230;\u00e7al\u0131\u015fanlar\u0131 korumak&#8230; i\u00e7in gerekli tedbirleri al\u0131r.&#8221; bi\u00e7imindeki uyulmas\u0131 zorunlu h\u00fck\u00fcmlerle, 657 say\u0131l\u0131 Yasa&#8217;n\u0131n 4\/C maddesindeki \u00e7al\u0131\u015fanlar\u0131n g\u00fcvence eksikli\u011fini ba\u011fda\u015ft\u0131rmak olana\u011f\u0131 yoktur. O halde Devlet, genel idare esaslar\u0131 d\u0131\u015f\u0131ndaki hizmetlerde birer &#8220;\u00e7al\u0131\u015ft\u0131r\u0131lan&#8221; konumunda bulunan 657 say\u0131l\u0131 Yasa&#8217;n\u0131n 4\/C maddesi kapsam\u0131ndaki personelin hukuksal stat\u00fcs\u00fcn\u00fc belirlemek ve istihdam g\u00fcvencesini sa\u011flamak i\u00e7in, yap\u0131lacak idari s\u00f6zle\u015fmelere esas olmak \u00fczere, Anayasa&#8217;n\u0131n 128. maddesinin ikinci f\u0131kras\u0131nda memur ya da di\u011fer kamu g\u00f6revlilerine, 49.-55. maddelerde i\u015f\u00e7ilere ili\u015fkin g\u00fcvencelerin benzerlerini \u00e7er\u00e7eve bir yasa ile kurallara ba\u011flamak zorundad\u0131r.<br \/>\nifadeleriyle, yasal d\u00fczenlemedeki eksikliklerin, \u00e7al\u0131\u015fma ili\u015fkisini \u201cg\u00fcvenceye kavu\u015fturan\u201d h\u00fck\u00fcmler ile giderilmesi gerekti\u011fini vurgulam\u0131\u015ft\u0131r. Yine Dan\u0131\u015ftay,<br \/>\n..Yasal bir \u00e7er\u00e7evenin bulunmamas\u0131 sonucunda davac\u0131 ile ayn\u0131 durumda olanlara i\u015f sonu tazminat\u0131 ad\u0131 alt\u0131nda bir \u00f6demede bulunulmazken \u00f6zelle\u015ftirme uygulamalar\u0131 sonucunda i\u015fsiz kalanlardan 657 say\u0131l\u0131 Yasa&#8217;n\u0131n 4\/C maddesi kapsam\u0131nda \u00e7al\u0131\u015fmay\u0131 kabul edenlerle s\u0131n\u0131rl\u0131 olarak 21.12.2009 g\u00fcnl\u00fc, 2009\/15279 say\u0131l\u0131 Bakanlar Kurulu karar\u0131yla, i\u015fsonu tazminat\u0131 \u00f6denmesi konusunda d\u00fczenleme yap\u0131larak, ayn\u0131 stat\u00fcde \u00e7al\u0131\u015fanlar aras\u0131nda da farkl\u0131 uygulama yap\u0131lmas\u0131na neden olunmu\u015ftur&#8230;<\/p>\n<p>diyerek, mevcut hukuka ayk\u0131r\u0131l\u0131\u011f\u0131n, 4\/C stat\u00fcs\u00fcnde farkl\u0131 kurumlarda \u00e7al\u0131\u015fanlar aras\u0131nda ayr\u0131mc\u0131l\u0131k yap\u0131lmas\u0131na yol a\u00e7t\u0131\u011f\u0131n\u0131 da ortaya koymu\u015ftur. Bunun somut \u00f6rne\u011fi, \u00f6zelle\u015ftirme ma\u011fduru 4\/C\u2019liler i\u00e7in yap\u0131lan iyile\u015ftirmelerin T\u00dc\u0130K\u2019de \u00e7al\u0131\u015fan 4\/C\u2019liler i\u00e7in gecikmeli uygulanmas\u0131, \u00fccret ve sosyal haklar y\u00f6n\u00fcnden farkl\u0131l\u0131klar olu\u015fmas\u0131d\u0131r. Ayn\u0131 stat\u00fcde \u00e7al\u0131\u015f\u0131lmas\u0131na ra\u011fmen farkl\u0131 \u00fccret ve sosyal haklara tabi tutulmak, anayasan\u0131n 10.maddesini de ihlal eden bir durumun do\u011fmas\u0131na neden olmu\u015ftur. <\/p>\n<p>An\u0131lan karara kar\u015f\u0131 oy kullanan Dan\u0131\u015ftay \u00fcyeleri dahi,<br \/>\n..Ge\u00e7ici personel istihdam\u0131, olduk\u00e7a s\u0131n\u0131rl\u0131 say\u0131da kurumda ger\u00e7ekle\u015ftirilmekte iken, 1985&#8217;li y\u0131llarda \u00f6zelle\u015ftirme ve Devletin k\u00fc\u00e7\u00fclt\u00fclmesi politikas\u0131yla yayg\u0131nla\u015ft\u0131r\u0131lm\u0131\u015f ve birden fazla s\u00f6zle\u015fme yinelemeleriyle belirsiz s\u00fcreli s\u00f6zle\u015fme d\u00f6nemi yarat\u0131lm\u0131\u015ft\u0131r. Kamu i\u015f\u00e7ili\u011fi gelene\u011fine kar\u015f\u0131, i\u015f hukukunda yeri olmayan bir \u00e7al\u0131\u015ft\u0131rma bi\u00e7imi olarak varl\u0131\u011f\u0131n\u0131 s\u00fcrd\u00fcren ve amac\u0131 d\u0131\u015f\u0131na ta\u015fan bu uygulama kamu istihdam\u0131 alan\u0131nda giderek yerini geni\u015fletmi\u015ftir. 657 say\u0131l\u0131 Yasa&#8217;n\u0131n 4. maddesinin (C) bendi kapsam\u0131nda istihdam edilen personelin hizmet s\u00f6zle\u015fmelerinin  yenilenerek uzat\u0131lm\u0131\u015f olmas\u0131 ve an\u0131lan personelin s\u00fcrekli i\u015flerde \u00e7al\u0131\u015ft\u0131r\u0131lmas\u0131, uygulama ile ilgili bir durum olup, bu durumun Anayasa&#8217;ya ayk\u0131r\u0131l\u0131\u011f\u0131n saptanmas\u0131nda belirleyici olmas\u0131 kabul edilemez. Zira, Anayasa yarg\u0131s\u0131, uygulamalar g\u00f6zetilerek de\u011fil, yasa h\u00fck\u00fcmleri incelenerek yap\u0131lmaktad\u0131r.<\/p>\n<p>diyerek, 4\/C uygulamas\u0131n\u0131n \u201chukuka ayk\u0131r\u0131\u201d olarak geni\u015fletildi\u011fini kabul etmi\u015fler, sadece, bu durumun Dan\u0131\u015ftay yetkisi dahilinde \u00e7\u00f6z\u00fcmlenebilece\u011fi noktas\u0131nda \u00e7o\u011funluk g\u00f6r\u00fc\u015f\u00fcne muhalif kalm\u0131\u015flard\u0131r. Bu gerek\u00e7eye dayal\u0131 kar\u015f\u0131 oy, 4\/C uygulamasn\u0131n hukuka ayk\u0131r\u0131l\u0131\u011f\u0131 konusunda Dan\u0131\u015ftay\u2019da geni\u015f bir uzla\u015fman\u0131n varl\u0131\u011f\u0131n\u0131 ortaya koymaktad\u0131r.  <\/p>\n<p>Anayasa Mahkemesi, Dan\u0131\u015ftay taraf\u0131ndan yap\u0131lan ba\u015fvuruda ilk incelemeyi yaparak, esas\u0131n incelenmesine karar vermi\u015ftir. Bu a\u015famadan sonra, dosya Raport\u00f6re verilecek ve esas incelemesine al\u0131nacakt\u0131r. Dile\u011fimiz, gerek kamuda gerekse de \u00f6zel sekt\u00f6rde, g\u00fcvencesiz \u00e7al\u0131\u015fma ili\u015fkileri d\u00f6neminin, bir daha a\u00e7\u0131lmamak \u00fczere kapanmas\u0131 ve artan zenginlikten t\u00fcm toplumun, \u00f6zellikle de vergi y\u00fck\u00fc (gelir gibi do\u011frudan KDV gibi dolayl\u0131 vergilerde) ba\u015fta olmak \u00fczere pek \u00e7ok y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc sessiz sedas\u0131z kabul eden \u00e7al\u0131\u015fan kesimin daha e\u015fit olarak yararlanmas\u0131d\u0131r.
