{"id":807,"date":"2010-03-04T12:00:00","date_gmt":"2010-03-04T12:00:00","guid":{"rendered":"http:\/\/haksen.org.tr\/?p=807"},"modified":"2010-03-04T12:00:00","modified_gmt":"2010-03-04T12:00:00","slug":"ankarada-ulasim-zammina-iptal","status":"publish","type":"post","link":"https:\/\/haksen.org.tr\/?p=807","title":{"rendered":"Ankara&#8217;da Ula\u015f\u0131m Zamm\u0131na \u0130ptal"},"content":{"rendered":"<p>Ankara B\u00fcy\u00fck\u015fehir Berlediye Ba\u015fkanl\u0131\u011f\u0131&#8217;na ba\u011fl\u0131 EGO Genel M\u00fcd\u00fcrl\u00fc\u011f\u00fc \u0130dare Enc\u00fcmeni taraf\u0131ndan Ankara i\u00e7ersindeki dolmu\u015f, otob\u00fcs, metro gibi toplu ta\u015f\u0131ma ara\u00e7lar\u0131na ili\u015fkin yolcu ta\u015f\u0131ma \u00fccretlerine 2005 y\u0131l\u0131 ba\u015f\u0131ndan itibaren ge\u00e7erli olmak \u00fczere y\u00fczde 33 zam yap\u0131lm\u0131\u015ft\u0131.<br \/>\nS\u00f6z konusu \u015fehir i\u00e7i toplu ta\u015f\u0131ma fiyat tarifelerindeki art\u0131\u015f\u0131n fahi\u015f oldu\u011fu, enflasyon oranlar\u0131n\u0131 dikkate al\u0131nmad\u0131\u011f\u0131, hukuka ve mevzuata uyarl\u0131k bulunmad\u0131\u011f\u0131 iddialar\u0131yla T\u00fcketici Haklar\u0131 Derne\u011fi ( THD) taraf\u0131ndan bu zamm\u0131n iptali i\u00e7in dava a\u00e7\u0131lm\u0131\u015ft\u0131.<br \/>\nBu s\u00fcre\u00e7 i\u00e7erisinde, Ankara 2.\u0130dare Mahkemesince verilen red karar\u0131n\u0131n THD taraf\u0131ndan temyiz edilmesi \u00fczerine, Dan\u0131\u015ftay 8.\u0130dare Mahkemesi&#8217;nin 2007 tarihinde verdi\u011fi bozma karar\u0131na Ankara 2.\u0130dare Mahkemesi taraf\u0131ndan uyularak 15.10.2009 tarihde oybirli\u011fi ile 2005 y\u0131l\u0131 ba\u015f\u0131ndan itibaren yap\u0131lan y\u00fczde 33 oran\u0131ndaki zamma ili\u015fkin i\u015flemin iptaline karar verilmi\u015ftir.<br \/>\nKararda;, dosya i\u00e7eri\u011finden toplumun b\u00fcy\u00fck bir k\u0131sm\u0131n\u0131 ilgilendiren toplu ta\u015f\u0131ma \u00fccretlerinin  artt\u0131r\u0131lmas\u0131na ili\u015fkin karar\u0131n g\u00fcndem d\u0131\u015f\u0131 teklifle g\u00f6r\u00fc\u015f\u00fcld\u00fc\u011f\u00fc, di\u011fer bir de\u011fi\u015fle bu konuda bir \u00f6n \u00e7al\u0131\u015fman\u0131n, derinlemesine ara\u015ft\u0131rmalar\u0131n yap\u0131lmad\u0131\u011f\u0131 ve konuyla ilgili kamu kurumu niteli\u011findeki  meslek kurulu\u015flar\u0131n\u0131n, karar\u0131n al\u0131nd\u0131\u011f\u0131 toplant\u0131da bulunmad\u0131klar\u0131 anla\u015f\u0131lmaktad\u0131r.<br \/>\n Bu itibarla, dava konusu i\u015flemden yakla\u015f\u0131k bir y\u0131l \u00f6nce 2.12.2003 g\u00fcn\u00fcn de yolcu ta\u015f\u0131ma  \u00fccretlerinde bir artt\u0131r\u0131m yap\u0131lm\u0131\u015f olmas\u0131na ra\u011fmen dava konusu artt\u0131r\u0131m\u0131 hakl\u0131 g\u00f6sterecek, temellendirecek nitelikte; ekonomik veriler \u0131\u015f\u0131\u011f\u0131nda yap\u0131lm\u0131\u015f de\u011ferlendirmeler, maliyet analizleri,  enflasyon oranlar\u0131 gibi bilimsel tespitlerin bulunmamas\u0131 gibi hususlar g\u00f6z\u00f6n\u00fcne al\u0131nd\u0131\u011f\u0131nda; somut bir gerek\u00e7eye dayan\u0131lmadan tesis edilen ve yakla\u015f\u0131k bir y\u0131l bir ay gibi bir s\u00fcrede toplam %50&#8217;nin \u00fczerinde fiyat art\u0131r\u0131m\u0131na yol a\u00e7an i\u015flemde kamu yarar\u0131na, hizmet gereklerine ve hukuka uyarl\u0131k bulunmamaktad\u0131r, denilmektedir.<br \/>\n Karar uyar\u0131nca ;8 Mart Pazartesi g\u00fcn\u00fcnden itibaren otob\u00fcslerde tam bilet 90 Kuru\u015f, \u00f6\u011frenci 60 Kuru\u015f, minib\u00fcslerde k\u0131sa mesafe 90 Kuru\u015f, uzun mesafe ise bir lira oldu.
