{"id":5258,"date":"2023-07-13T16:20:46","date_gmt":"2023-07-13T13:20:46","guid":{"rendered":"https:\/\/haksen.org.tr\/?p=5258"},"modified":"2023-07-13T16:20:50","modified_gmt":"2023-07-13T13:20:50","slug":"civi-goc-idaresi-geri-gonderme-merkezi-personeli-yabancilarin-siddetine-maruz-kaliyor","status":"publish","type":"post","link":"https:\/\/haksen.org.tr\/?p=5258","title":{"rendered":"\u00c7ivi; G\u00f6\u00e7 \u0130daresi Geri G\u00f6nderme Merkezi personeli yabanc\u0131lar\u0131n \u015fiddetine maruz kal\u0131yor !"},"content":{"rendered":"\n<p>Kamu \u00c7al\u0131\u015fanlar\u0131 Hak Sendikalar\u0131 Konfederasyonu (HAKSEN) Genel Ba\u015fkan\u0131 Ayhan \u00c7ivi, geri g\u00f6nderme merkezlerinde \u00e7al\u0131\u015fan kamu personelinin yemek ve izin gibi haklar\u0131n\u0131 kullanmakta s\u0131k\u0131nt\u0131 ya\u015fad\u0131klar\u0131n\u0131, yasal d\u00fczenleme olmad\u0131\u011f\u0131 i\u00e7in yabanc\u0131lar\u0131n s\u00f6zl\u00fc ve fiili taciz ve sald\u0131r\u0131lar\u0131na maruz kald\u0131klar\u0131n\u0131 savundu. \u00c7ivi, &#8220;\u00d6zellikle 5188 say\u0131l\u0131 \u00d6zel G\u00fcvenlik Kanunu\u2019na g\u00f6re g\u00f6rev yapan g\u00fcvenlik personeli, b\u00fcy\u00fck \u00f6l\u00e7\u00fcde bu yabanc\u0131larla mesaileri boyunca muhatap olmakta ve bu yabanc\u0131larla ilgili herhangi bir yapt\u0131r\u0131m uygulanmamas\u0131 nedeniyle yabanc\u0131lar\u0131n s\u00f6zl\u00fc ve fiili sald\u0131r\u0131lar\u0131na, tacizlerine maruz kalmaktalar&#8221; dedi.<\/p>\n\n\n\n<p>HAKSEN Genel Ba\u015fkan\u0131 Ayhan \u00c7ivi, G\u00f6\u00e7 \u0130daresi b\u00fcnyesinde \u00e7al\u0131\u015fan g\u00fcvenlik ve koruma personellerinin gerekli yasal d\u00fczenleme olmad\u0131\u011f\u0131 i\u00e7in hak kayb\u0131na u\u011frad\u0131\u011f\u0131n\u0131 s\u00f6yledi. Yabanc\u0131lar\u0131n uymas\u0131 gereken kurallar ve yapt\u0131r\u0131m\u0131yla ilgili olarak G\u00f6\u00e7 \u0130daresi taraf\u0131ndan mutlaka bir yasal d\u00fczenleme y\u00fcr\u00fcrl\u00fc\u011fe konulmas\u0131 gerekti\u011fini ifade eden \u00c7ivi, personelin eksikli\u011fi nedeniyle y\u0131ll\u0131k ve idari izinlerin kullan\u0131lmas\u0131nda ciddi k\u0131s\u0131tlamalar ya\u015fand\u0131\u011f\u0131n\u0131 s\u00f6yledi.&nbsp;<\/p>\n\n\n\n<p><strong>&#8220;YABANCILARIN \u0130DAR\u0130 G\u00d6ZET\u0130MDE \u0130KEN UYMASI GEREKEN KURALLARLA \u0130LG\u0130L\u0130 B\u0130R MEVZUAT YOK&#8221;<\/strong><\/p>\n\n\n\n<p>Ayhan \u00c7ivi, bug\u00fcn yapt\u0131\u011f\u0131 a\u00e7\u0131klamada \u015funlar\u0131 s\u00f6yledi:<\/p>\n\n\n\n<p>&#8220;Bug\u00fcn kamuoyunun bilmedi\u011fi ama \u00e7al\u0131\u015fanlar\u0131 ma\u011fdur eden bir hususu payla\u015fmak istiyorum. \u00dclkemizde kal\u0131\u015f hakk\u0131 bulunmayan ve \u00fclkelerine geri g\u00f6nderilecek olan yabanc\u0131lardan, haklar\u0131nda idari g\u00f6zetim hakk\u0131 bulunanlar G\u00f6\u00e7 \u0130daresi b\u00fcnyesindeki geri g\u00f6nderme merkezlerinde tutulmaktad\u0131r. S\u00f6z konusu yabanc\u0131lar\u0131n haklar\u0131 gerek uluslararas\u0131 gerekse ulusal mevzuat\u0131m\u0131zda belirlenmi\u015f olup, idari g\u00f6zetimde bulunduklar\u0131 s\u00fcrede uyulmas\u0131 gereken kurallarla ilgili herhangi bir d\u00fczenleme bulunmamaktad\u0131r. Bu durum geri g\u00f6nderme merkezlerinde g\u00f6rev yapan \u00e7al\u0131\u015fanlar a\u00e7\u0131s\u0131ndan ciddi ma\u011fduriyetler yaratmaktad\u0131r.&nbsp;\u00d6zellikle 5188 say\u0131l\u0131 \u00d6zel G\u00fcvenlik Kanunu\u2019na g\u00f6re g\u00f6rev yapan g\u00fcvenlik personeli, b\u00fcy\u00fck \u00f6l\u00e7\u00fcde bu yabanc\u0131larla mesaileri boyunca muhatap olmakta ve bu yabanc\u0131larla ilgili herhangi bir yapt\u0131r\u0131m uygulanmamas\u0131 nedeniyle yabanc\u0131lar\u0131n s\u00f6zl\u00fc ve fiili sald\u0131r\u0131lar\u0131na, tacizlerine maruz kalmaktalar. Buna kar\u015f\u0131 da bir tepki olu\u015ftu\u011funda, personel hakk\u0131nda idari soru\u015fturma yap\u0131lmakta ve personel bu anlamda kendisini ciddi bask\u0131 alt\u0131nda hissetmektedir.&nbsp; Dolay\u0131s\u0131yla bu yabanc\u0131lar\u0131n uymas\u0131 gereken kurallar ve yapt\u0131r\u0131m\u0131yla ilgili olarak G\u00f6\u00e7 \u0130daresi taraf\u0131ndan mutlaka bir yasal d\u00fczenleme y\u00fcr\u00fcrl\u00fc\u011fe konulmal\u0131d\u0131r.<\/p>\n\n\n\n<p><strong>&#8220;PERSONEL\u0130N NE ZAMAN \u0130Z\u0130N YAPACA\u011eINA \u0130DAREC\u0130LER KARAR VER\u0130YOR&#8221;<\/strong><\/p>\n\n\n\n<p>Di\u011fer taraftan, bu geri g\u00f6nderme merkezlerindeki sa\u011fl\u0131k hizmetleri ve ila\u00e7 da\u011f\u0131t\u0131m\u0131 yine bu g\u00fcvenlik g\u00f6revlileri taraf\u0131ndan yap\u0131lmakta. Bu da onlar a\u00e7\u0131s\u0131ndan g\u00f6revleri olmad\u0131\u011f\u0131 halde ciddi bir risk olu\u015fturmaktad\u0131r. Bu geri g\u00f6nderme merkezlerinde g\u00f6rev yapan koruma ve g\u00fcvenlik g\u00f6revlileri 12-36 saat esas\u0131na g\u00f6re \u00e7al\u0131\u015f\u0131yorlar. Ve bundan kaynakl\u0131 olarak fazla mesaileri olu\u015fuyor. Ancak herhangi bir idari izin verilmiyor. N\u00f6betteki personele \u00fccretsiz yemek verilmesi gerekirken, yemek verilmiyor Bununla birlikte, y\u0131ll\u0131k izinler ve idari izinlerin kullan\u0131lmas\u0131nda, personel yetersizli\u011fi y\u00fcz\u00fcnden ciddi k\u0131s\u0131tlamalar var. Ayr\u0131ca 4B i\u015f\u00e7i stat\u00fcs\u00fcndeki koruma g\u00f6revlileri, kamu personeli olan g\u00fcvenlik g\u00f6revlilerinin ba\u015f\u0131na amir olarak atan\u0131yor. Bu amir olarak atanma konusu i\u00e7in belirlenmi\u015f bir usul ve kriter bulunmuyor. Bu da tamamen idarenin keyfiyetinde bir durum olarak duruyor. Biz bu arkada\u015flar\u0131m\u0131z\u0131n sorunlar\u0131n\u0131 biliyoruz. Bu konuda G\u00f6\u00e7 \u0130daresi Ba\u015fkanl\u0131\u011f\u0131\u2019na yaz\u0131l\u0131 ba\u015fvurumuzu yapt\u0131k.
