Hak arama m\u00fccadelesindeki dayana\u011f\u0131m\u0131z bize yetki veren kamu \u00e7al\u0131\u015fanlar\u0131 ve yasal haklar\u0131m\u0131zd\u0131r. Siyasi ve ideolojik hi\u00e7bir referansa dayanmadan, evrensel sendikal de\u011ferleri esas alarak insan odakl\u0131 \u00e7al\u0131\u015fmalar yap\u0131yoruz, dedi.<\/p>\n<p><strong>\u00c7ivi a\u00e7\u0131klamas\u0131nda; <\/strong><\/p>\n<p>Sosyal taraf olarak gerek kamu \u00e7al\u0131\u015fanlar\u0131n\u0131n sendikam\u0131za iletti\u011fi, gerekse alanda tespit etti\u011fimiz sorunlar ile makul ve mant\u0131kl\u0131 \u00e7\u00f6z\u00fcm \u00f6nerilerimizi h\u00fckumete ve mecliste yetkililere ileterek, kamuoyuyla da payla\u015f\u0131yoruz.\u00a0 Sendika \u00fcyelerimizin maruz kald\u0131\u011f\u0131 hak ihlallerinin \u00f6nlenmesi ve ma\u011fduriyetlerinin giderilmesi konusunda gerek idari gerekse hukuki yollarla yasalar\u0131n verdi\u011fi t\u00fcm yetkileri teredd\u00fcts\u00fcz kullan\u0131yoruz, dedi.<\/p>\n<p>Haksen Genel Ba\u015fkan\u0131 Ayhan \u00c7ivi, kamu \u00e7al\u0131\u015fanlar\u0131n\u0131n acil \u00e7\u00f6z\u00fcm bekleyen sorunlar\u0131na ili\u015fkin de \u015fu tespitlerini s\u0131ralad\u0131.<\/p>\n<p><strong>MEMURLARIN SEND\u0130KA \u0130\u015eLEMLER\u0130N\u0130N E-DEVLET \u00dcZER\u0130NDEN YAPILMASI<\/strong><\/p>\n<p>4688 say\u0131l\u0131 Kamu G\u00f6revlileri Sendikalar\u0131 ve Toplu S\u00f6zle\u015fme Kanunu uyar\u0131nca halen kamu g\u00f6revlilerinin sendika \u00fcyelik ve istifa i\u015flemleri \u0131slak imzal\u0131 formlarla yap\u0131larak kamu kurumlar\u0131n\u0131n i\u015fleme koymas\u0131ndan sonra resmiyet kazanmaktad\u0131r.<\/p>\n<p>Bu durum sendikal \u00f6zg\u00fcrl\u00fckler a\u00e7\u0131s\u0131ndan pek \u00e7ok sorunlara neden olmaktad\u0131r.<\/p>\n<p>Kamu kurumlar\u0131n\u0131n y\u00f6neticileri yetkilerini kullanarak \u00fcyelik i\u015flemlerine ve istifa i\u015flemlerine m\u00fcdahil olabilmekte, memurlar\u0131n \u00fczerinde bask\u0131 yaratmaktad\u0131r.<\/p>\n<p>Halen, i\u015f\u00e7i sendikalar\u0131n\u0131n t\u00fcm i\u015flemleri e-Devlet sistemi \u00fczerinde yap\u0131lmaktad\u0131r.<\/p>\n<p>Ayn\u0131 \u015fekilde memurlar\u0131n sendikal i\u015flemlerinin e-Devlet \u00fczerinden yap\u0131lmas\u0131n\u0131n hi\u00e7bir ek maliyeti bulunmamaktad\u0131r.<\/p>\n<p><strong>\u00c7ALI\u015eANLARIN GEL\u0130R VERG\u0130S\u0130 ORANLARININ D\u00dc\u015e\u00dcR\u00dcLMES\u0130<\/strong><\/p>\n<p>Kamu \u00e7al\u0131\u015fanlar\u0131n\u0131n maa\u015flar\u0131ndan yap\u0131lan gelir vergisi oranlar\u0131n\u0131n y\u00fcksekli\u011fi ve vergi matrah\u0131 dilimlerinin d\u00fc\u015f\u00fck tutulmas\u0131 nedeniyle yap\u0131lan maa\u015f art\u0131\u015flar\u0131 tam olarak yans\u0131mamaktad\u0131r.<\/p>\n<p>Y\u0131l\u0131n ikinci alt\u0131 ay\u0131 i\u00e7in verilen maa\u015f art\u0131\u015f\u0131 gelir vergisi ile geri al\u0131nmaktad\u0131r.<\/p>\n<p>Bu nedenle, gelir vergisi oranlar\u0131n\u0131n d\u00fc\u015f\u00fcr\u00fclerek, vergi matrah\u0131 dilimlerinin art\u0131r\u0131lmas\u0131 halinde yap\u0131lan art\u0131\u015flar tam olara maa\u015flara yans\u0131m\u0131\u015f olacakt\u0131r.<\/p>\n<p><strong>S\u00d6ZLE\u015eMEL\u0130 PERSONEL\u0130N KADROYA GE\u00c7\u0130R\u0130LMES\u0130<\/strong><\/p>\n<p>\u0130stihdam edilen s\u00f6zle\u015fmeli personelin b\u00fcy\u00fck bir k\u0131sm\u0131 kadrolu kamu personeli ile ayn\u0131 g\u00f6revi y\u00fcr\u00fctmekle birlikte tabi olduklar\u0131 mevzuat nedeniyle i\u015f g\u00fcvencesi ba\u015fta olmak \u00fczere mali ve sosyal haklar a\u00e7\u0131s\u0131ndan ortaya \u00e7\u0131kan hak kay\u0131plar\u0131n\u0131 \u015fu \u015fekilde \u00f6zetleyebiliriz.<\/p>\n<ul>\n<li>E\u015f durumu, sa\u011fl\u0131k durumu ve g\u00fcvenlik nedenleri d\u0131\u015f\u0131nda yer de\u011fi\u015fikli\u011fi haklar\u0131 bulunmamaktad\u0131r.<\/li>\n<li>G\u00f6revde y\u00fckselme ve unvan de\u011fi\u015fikli\u011fi haklar\u0131 bulunmamaktad\u0131r.<\/li>\n<li>Br\u00fct s\u00f6zle\u015fme \u00fccretinin tamam\u0131 ssk primine ve vergiye tabidir. Bu nedenle y\u0131l\u0131n ikinci yar\u0131s\u0131nda verilen maa\u015f zamlar\u0131 vergi olarak geri al\u0131nmaktad\u0131r.<\/li>\n<li>Zorunlu nedenlere ba\u011fl\u0131 olarak ba\u015fka bir yere nakil olduklar\u0131nda yolluk ve mehil m\u00fcddetleri bulunmamaktad\u0131r.<\/li>\n<li>Di\u011fer kamu kurumlar\u0131na nakil haklar\u0131 bulunmamaktad\u0131r.<\/li>\n<li>Y\u0131ll\u0131k izinleri bir sonraki y\u0131la devretmemektedir.<\/li>\n<li>Do\u011fum ve askerlik mazareti d\u0131\u015f\u0131nda \u00fccretsiz izin haklar\u0131 bulunmamaktad\u0131r.<\/li>\n<li>Emekli olduklar\u0131nda tazminatlar\u0131 brut s\u00f6zle\u015fme \u00fccreti \u00fczerinde de\u011fil, emsali kadrolu memura k\u0131yasen \u00f6denmektedir.<\/li>\n<li>Emeklilikte memura \u00f6denen yol \u00fccreti \u00f6denmemektedir.<\/li>\n<li>\u0130\u015f g\u00fcvencelerinin bulunmamas\u0131 nedeniyle mobbinge maruz kalmakta ve i\u015fini kaybetme korkusu alt\u0131nda ya\u015famaktad\u0131r.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p>Memurlu\u011fu di\u011fer istihdam bi\u00e7imlerinden ay\u0131ran en \u00f6nemli \u00f6zellik stat\u00fcs\u00fcn\u00fcn \u00f6zel bir kanunla d\u00fczenlenmi\u015f olmas\u0131 ve geni\u015f sosyal haklarla (\u00f6zellikle izin hakk\u0131) \u201ci\u015f g\u00fcvencesi\u201d sa\u011flayan bir istihdam bi\u00e7imi olmas\u0131d\u0131r. \u0130\u015f g\u00fcvencesi, memurun g\u00f6revini yerine getirirken tarafs\u0131z davranmas\u0131n\u0131, kamu yarar\u0131n\u0131 g\u00f6zetmesini; politik ya da \u00f6zel d\u0131\u015f etkilere kapal\u0131 olmas\u0131n\u0131 sa\u011flamak i\u00e7indir. Bu a\u00e7\u0131dan da s\u00f6zle\u015fmeli kamu personelinin kadroya al\u0131nmas\u0131 \u00f6nem arz etmektedir.<\/p>\n<p><strong>EK \u00d6DEMELER\u0130N EMEKL\u0130 AYLI\u011eINA D\u00c2H\u0130L ED\u0130LMES\u0130<\/strong><\/p>\n<p>Kamu g\u00f6revlilerinin b\u00fcy\u00fck bir \u00e7o\u011funlu\u011funu ilgilendiren en \u00f6nemli konulardan birisi de maa\u015flara ek olarak yap\u0131lan \u00f6demelerin emekli maa\u015f\u0131n\u0131n hesaplanmas\u0131nda dikkate al\u0131nmamas\u0131d\u0131r. Bu nedenle, kamu g\u00f6revlilerinin fiilen \u00e7al\u0131\u015f\u0131rken almakta olduklar\u0131 \u00fccret ile emekli maa\u015flar\u0131 aras\u0131nda \u00e7ok ciddi fark olu\u015fmaktad\u0131r. Emekli ayl\u0131klar\u0131ndaki ciddi d\u00fc\u015f\u00fc\u015f nedeniyle emeklilik hakk\u0131n\u0131 elde eden kamu \u00e7al\u0131\u015fanlar\u0131 aile sorumluluklar\u0131n\u0131 yerine getirebilmek i\u00e7in \u00e7al\u0131\u015fmaya devam etmek zorunda kalmaktad\u0131r. Buna ra\u011fmen emekli olmak zorunda kalanlar ise bir ba\u015fka i\u015f aramak zorunda kalmaktad\u0131r.<\/p>\n<p>Bu durum;<\/p>\n<ul>\n<li>kamudaki personelin ya\u015f ortalamas\u0131n\u0131n y\u00fckselmesine,<\/li>\n<li>alt unvanlardaki personelin g\u00f6revde y\u00fckselme f\u0131rsat\u0131n\u0131n azalmas\u0131na,<\/li>\n<li>kamuya yeni personel istihdam\u0131n\u0131n daralmas\u0131na,<\/li>\n<li>hizmet sunumunda verim azalmas\u0131na, neden olmaktad\u0131r.<\/li>\n<\/ul>\n<p>Emekli ayl\u0131\u011f\u0131ndaki d\u00fc\u015f\u00fc\u015f\u00fcn \u00f6nemli bir b\u00f6l\u00fcm\u00fc,\u00a0 fiilen \u00e7al\u0131\u015f\u0131rken maa\u015f\u0131yla birlikte yap\u0131lmakta olan ek \u00f6demenin emekli ayl\u0131\u011f\u0131 hesab\u0131na d\u00e2hil edilmemesinden kaynaklanmaktad\u0131r.<\/p>\n<p>Emekli olmalar\u0131 halinde halen almakta olduklar\u0131 \u00fccretin; M\u00fchendis y\u00fczde 61\u2019ini, \u015eube M\u00fcd\u00fcr\u00fc y\u00fczde 55\u2019ini, \u00d6\u011fretmen y\u00fczde 54\u2019\u00fcn\u00fc, Sa\u011fl\u0131k Memuru y\u00fczde 50\u2019sini, Gelir Uzman\u0131 y\u00fczde 42\u2019sini, Polis Memuru y\u00fczde 40\u2019\u0131n\u0131 Emekli ayl\u0131\u011f\u0131 olarak alacakt\u0131r.<\/p>\n<p><strong>KURUMLAR ARASINDAK\u0130 \u00dcCRET FARKLILI\u011eININ G\u0130DER\u0130LMES\u0130<\/strong><\/p>\n<p>Y\u0131llardan beri \u00e7\u00f6z\u00fcm bekleyen sorunlar\u0131n ba\u015f\u0131nda kurumlar aras\u0131 \u00fccret adaletsizli\u011fi bulunmaktad\u0131r. Resmi kurumlar; ayn\u0131 pozisyonda bulunan personele farkl\u0131 maa\u015flar \u00f6demekte, bu durum \u00e7al\u0131\u015fma bar\u0131\u015f\u0131n\u0131 da olumsuz etkilemektedir. Ayn\u0131 sebepten; y\u00fcksek \u00fccret \u00f6deyen kurumlarda personel y\u0131\u011f\u0131lmalar\u0131 olmakta iken d\u00fc\u015f\u00fck \u00fccret \u00f6deyen kurumlarda nitelikli personel yetersizli\u011fi ortaya \u00e7\u0131kmaktad\u0131r.<\/p>\n<p><strong>3600 EK G\u00d6STERGE T\u00dcM \u00c7ALI\u015eANA VER\u0130LMEL\u0130:<\/strong><\/p>\n<p>3600 Ek g\u00f6sterge; Cumhurba\u015fkan\u0131m\u0131z taraf\u0131ndan baz\u0131 meslek mensuplar\u0131na 3600 ek g\u00f6stergesi verilece\u011fi ifade edilmi\u015f olmakla birlikte 3600 ek g\u00f6sterge d\u00fczenlemesinin t\u00fcm kamu \u00e7al\u0131\u015fanlar\u0131n\u0131 kapsayacak \u015fekilde d\u00fczenlenmesi gerekmektedir.<\/p>\n<p>\u00c7al\u0131\u015fma bar\u0131\u015f\u0131n\u0131n korunmas\u0131 ve hukuki ihtilaflar\u0131n \u00f6n\u00fcne ge\u00e7ilebilmesi i\u00e7in t\u00fcm kamu \u00e7al\u0131\u015fanlar\u0131n\u0131n ek g\u00f6stergesinin 3600\u2019den ba\u015flayarak kademeli olarak art\u0131r\u0131lmas\u0131n\u0131 talep ediyoruz.<\/p>\n<p>\u00d6RNEK:Ek g\u00f6stergesi olmayana Ek g\u00f6sterge, 2200 Olana 3600, 3600 olana 4800 gibi.<\/p>\n<p><strong>(YHS) KAMUDA YARDIMCI H\u0130ZMETLER:<\/strong><\/p>\n<p>(YHS) Kamuda Yard\u0131mc\u0131 Hizmetler; Aralar\u0131nda \u00dcniversite mezunlarda bulunan \u00c7ayc\u0131, Odac\u0131, Temizlik dahil, t\u00fcm geri hizmetinde kullan\u0131lan ve Ek g\u00f6stergesi&#8217;de bulunmayan Kanunda yard\u0131mc\u0131 hizmetler s\u0131n\u0131f\u0131nda \u00e7al\u0131\u015fanlar\u0131n g\u00f6rev tan\u0131m\u0131 belirsiz oldu\u011fu i\u00e7in uygulamada b\u00fcy\u00fck s\u0131k\u0131nt\u0131 ya\u015fan\u0131yor.\u00a0Devlet memurlar\u0131ndan sadece yard\u0131mc\u0131 hizmetler s\u0131n\u0131f\u0131 \u00e7al\u0131\u015fanlar\u0131n\u0131n ek g\u00f6stergesi bulunmuyor. Bu hem maa\u015flar\u0131na, hem de emekli ayl\u0131klar\u0131na olumsuz yans\u0131yor. Hak-Sen Olarak; yard\u0131mc\u0131 hizmetler s\u0131n\u0131f\u0131n\u0131n kald\u0131r\u0131lmas\u0131 \u0130dari hizmetler s\u0131n\u0131f\u0131na ge\u00e7irilmesi, ek g\u00f6sterge verilmesini istemekteyiz.<\/p>\n<p><strong>\u00a0UNVAN DE\u011e\u0130\u015e\u0130KL\u0130\u011e\u0130 SINAVININ KALDIRILMASI:<\/strong><\/p>\n<p>Devlet memurlar\u0131 olarak; bitirdi\u011fimiz okullar\u0131n dikkate al\u0131nmamas\u0131, hak etti\u011fimiz unvan ve kadrolar\u0131n verilmemesi nedeniyle ma\u011fdur.<\/p>\n<p>Devletin e\u011fitim kurumlar\u0131ndan diploma alabilmek i\u00e7in maddi ve manevi nice emekler veriyor, bilgi ve becerimizi art\u0131rabilmek ad\u0131na ailemizle ge\u00e7irece\u011fimiz zamanlardan feragat ediyoruz. Ve en sonunda hak etti\u011fimiz diplomalar\u0131 al\u0131yor.<\/p>\n<p>Ancak; 1999 tarihinde \u00e7\u0131kart\u0131lan bir kanun kapsam\u0131nda, devletin e\u011fitim kurumlar\u0131ndan ald\u0131\u011f\u0131m\u0131z diplomalar yine devletin resmi kurumlar\u0131nca tan\u0131nm\u0131yor, yok say\u0131l\u0131yor. Teknisyen, tekniker, m\u00fchendis olabilmek i\u00e7in yeniden g\u00f6revde y\u00fckselme ve unvan de\u011fi\u015fikli\u011fi s\u0131navlar\u0131na tabi tutuluyor. Kimi zaman yetersiz say\u0131da, kimi zaman da farkl\u0131 \u015fehirlere gitmek \u015fart\u0131yla a\u00e7\u0131lan bu s\u0131navlar\u0131 kazansa bile; tecr\u00fcbe kazand\u0131\u011f\u0131 birimlerden farkl\u0131 birimlere atan\u0131yor ya da yeni bir \u015fehre ta\u015f\u0131narak aile b\u00fct\u00fcnl\u00fc\u011f\u00fcm\u00fcz\u00fc tehdit eden sorunlarla kar\u015f\u0131 kar\u015f\u0131ya kal\u0131yor.<\/p>\n<p>\u0130ste\u011fimiz; \u015fef, m\u00fcd\u00fcr, ba\u015fkan olmak de\u011fil, makam istemiyoruz. Sadece diplomalar\u0131m\u0131z\u0131 alarak hak etti\u011fimiz unvanlar\u0131m\u0131z\u0131n s\u0131nava tabi tutulmadan verilmesini istiyoruz. \u00dclkemiz genelinde \u00e7ok say\u0131da memurumuz bu sorundan dolay\u0131 muzdariptir.<\/p>\n<p>Hak-Sen Olarak s\u00fcrekli dile getirdi\u011fimizin sonucu olarak; \u00a0sesimizi duyurarak ba\u015fard\u0131\u011f\u0131m\u0131z ve h\u00fckumet taraf\u0131ndan \u00a0KHK yay\u0131nlanmas\u0131 ile birlikte 4\/B stat\u00fcs\u00fcnde \u00e7al\u0131\u015fanlar Diploma kar\u015f\u0131l\u0131\u011f\u0131 olan unvanlarla birlikte 4\/A stat\u00fcs\u00fcne ge\u00e7irildi\u00a0 4\/B stat\u00fcs\u00fc \u00e7al\u0131\u015fanlar\u0131 ma\u011fduriyetleri\u00a0 giderildi. &#8220;H\u00fckumetimize Te\u015fekk\u00fcr ederiz.&#8221;<\/p>\n<p>Lakin, Y\u0131llarca Devlet kurumlar\u0131nda hizmet veren 4\/A l\u0131 stat\u00fcs\u00fcnde \u00e7al\u0131\u015fan memurlara diploma kar\u015f\u0131l\u0131\u011f\u0131 unvanlar\u0131n verilmesin i\u00e7in s\u0131nava tabi tutuldu, \u00a0buda onca y\u0131l hizmet etmi\u015f s\u0131nav a\u00e7\u0131lmayan a\u00e7\u0131lsa da \u00e7al\u0131\u015ft\u0131\u011f\u0131 yerde bildi\u011fi i\u015fi yaparak aksamalara meydan vermemek i\u00e7in ve aile b\u00fct\u00fcnl\u00fc\u011f\u00fcn\u00fc bozmamak i\u00e7in s\u0131navlara girmedi. KHK ile 4\/A ya ge\u00e7irilen 4\/B stat\u00fc \u00e7al\u0131\u015fanlar\u0131nda onca y\u0131l \u00e7al\u0131\u015fm\u0131\u015f kendilerinden daha tecr\u00fcbeli olan \u00e7al\u0131\u015fanlar\u0131n amirleri olarak atand\u0131.<\/p>\n<p>Bu haks\u0131zl\u0131\u011f\u0131nda giderebilmek i\u00e7in 4\/A&#8217; l\u0131 t\u00fcm \u00e7al\u0131\u015fanlara da s\u0131navs\u0131z KHK ile unvanlar\u0131n verilmesi ma\u011fduriyeti giderecektir dedi.<\/p>\n<p><strong>\u00dcN\u0130VERS\u0130TELERDE G\u00d6REV YAPAN \u0130DAR\u0130 PERSONELE NAK\u0130L HAKKININ D\u00dcZENLENMES\u0130<\/strong><\/p>\n<p>\u00dcniversitelerde g\u00f6rev yapan idari personelin g\u00f6rev yapt\u0131\u011f\u0131 ilden ba\u015fka bir ile nakil hakk\u0131na ili\u015fkin bir yasal d\u00fczenleme bulunmamaktad\u0131r. S\u00f6z konusu personel ancak kurumlar aras\u0131 nakil mevzuat\u0131na tabi tutulmaktad\u0131r.
