{"id":4610,"date":"2020-01-07T17:50:06","date_gmt":"2020-01-07T14:50:06","guid":{"rendered":"https:\/\/haksen.org.tr\/?p=4610"},"modified":"2020-02-06T18:15:45","modified_gmt":"2020-02-06T15:15:45","slug":"mahkeme-sozlesmeli-personelin-otizmli-cocugu-icin-refakat-izni-kullanabilecegine-karar-verdi","status":"publish","type":"post","link":"https:\/\/haksen.org.tr\/?p=4610","title":{"rendered":"Mahkeme, S\u00f6zle\u015fmeli Personelin Otizmli \u00c7ocu\u011fu \u0130\u00e7in Refakat \u0130zni Kullanabilece\u011fine Karar Verdi"},"content":{"rendered":"<p>Mahkeme, S\u00f6zle\u015fmeli Personelin Otizmli \u00c7ocu\u011fu \u0130\u00e7in Refakat \u0130zni Kullanabilece\u011fine Karar Verdi.<br \/>\nKamu \u00c7al\u0131\u015fanlar\u0131 Hak Sendikalar\u0131 Konfederasyonu (HAKSEN)  hukuk m\u00fc\u015favirli\u011fince a\u00e7\u0131lan davada;  idare mahkemesi s\u00f6zle\u015fmeli personel olarak \u00e7al\u0131\u015fan annenin, otizmli \u00e7ocu\u011fu i\u00e7in refakat izni kullanabilece\u011fine, karar verdi.<\/p>\n<p>Karar sonucu, Haksen \u00fcyesi anneye 3 ay s\u00fcreyle refakat izni verilmi\u015ftir. <\/p>\n<p>T\u00fcrkiye \u0130statistik Kurumu (T\u00dc\u0130K) b\u00fcnyesinde 657 say\u0131l\u0131 Devlet Memurlar\u0131 Kanunu (DMK) uyar\u0131nca s\u00f6zle\u015fmeli personel (4\/B) stat\u00fcs\u00fcnde \u00e7al\u0131\u015fmakta olan bir personelin k\u00fc\u00e7\u00fck \u00e7ocu\u011fu hakk\u0131nda otizm te\u015fhisi yap\u0131lmas\u0131 \u00fczerine, \u00fc\u00e7 ay s\u00fcreyle refakat izin talebinin idare taraf\u0131ndan reddedilmesi \u00fczerine a\u00e7\u0131lan davada, Samsun 3.\u0130dare Mahkemesi taraf\u0131ndan verilen 18.12.2019 tarihli karar, 4\/B s\u00f6zle\u015fmeli personel stat\u00fcs\u00fc, otizm hastal\u0131\u011f\u0131, \u00e7ocuk haklar\u0131 ve kad\u0131n\u0131n \u00e7al\u0131\u015fma hayat\u0131ndaki rol\u00fc ile ilgili \u00f6nemli tespitler i\u00e7eriyor.<\/p>\n<p>Olay\u0131 k\u0131saca \u00f6zetlemek gerekirse; T\u00dc\u0130K Samsun B\u00f6lge M\u00fcd\u00fcrl\u00fc\u011f\u00fcnde \u00e7al\u0131\u015fmakta olan ba\u015fvurucu, daha \u00f6nce ge\u00e7ici i\u015f\u00e7i (m\u00fclga 4\/C) stat\u00fcs\u00fcnde \u00e7al\u0131\u015fm\u0131\u015f; daha sonra 696 say\u0131l\u0131 KHK ile 4\/B stat\u00fcs\u00fcne ge\u00e7erek \u00e7al\u0131\u015fmaya devam etmi\u015ftir. \u00c7al\u0131\u015fan, k\u00fc\u00e7\u00fck ya\u015ftaki \u00e7ocu\u011funa \u201c\u00e7ocukluk otizmi\u201d te\u015fhisinin konulmas\u0131 \u00fczerine, durumu bildirir sa\u011fl\u0131k kurul raporu ile birlikte idareye ba\u015fvurarak \u00fc\u00e7 ay s\u00fcreyle refakat izin talebinde bulunmu\u015ftur.<\/p>\n<p>\u0130dare cevab\u0131nda; \u201cS\u00f6zle\u015fmeli Personel \u00c7al\u0131\u015ft\u0131r\u0131lmas\u0131na \u0130li\u015fkin Esaslar\u0131\u201d d\u00fczenleyen Bakanlar Kurulunun ilgili maddesine at\u0131fla, sa\u011fl\u0131k kurulu raporunda,<br \/>\n1. Refakati gerektiren t\u0131bbi sebepler,<br \/>\n2. Refakat edilmedi\u011fi takdirde hayati tehlike bulunup bulunmad\u0131\u011f\u0131,<br \/>\n3. S\u00fcrekli ve yak\u0131n bak\u0131m gerekip gerekmedi\u011fi,<br \/>\n4. \u00dc\u00e7 ay\u0131 ge\u00e7meyecek \u015fekilde refakat s\u00fcresi,<br \/>\n5. Varsa refakat\u00e7inin sahip olmas\u0131 gereken \u00f6zel nitelikleri,<br \/>\nunsurlar\u0131ndan ilk d\u00f6rd\u00fcn\u00fcn zorunlu olarak bulunmas\u0131 gerekti\u011fini, ba\u015fvurucu taraf\u0131ndan sunulan raporda \u201crefakat edilmedi\u011fi takdirde hayati tehlike bulundu\u011fu\u201d ifadesi yaz\u0131lmad\u0131\u011f\u0131 gerek\u00e7esiyle, talebin reddine karar vermi\u015ftir.<br \/>\n\u0130darenin a\u015f\u0131r\u0131 \u015fekilci yakla\u015f\u0131m\u0131 sonucunda, 657 say\u0131l\u0131 DMK\u2019n\u0131n 105.maddesinde, raporda \u201crefakat edilmedi\u011fi takdirde hayati tehlike bulundu\u011fu\u201d ifadesinin yaz\u0131lma zorunlulu\u011fu bulunmad\u0131\u011f\u0131 gerek\u00e7esiyle, idare i\u015flemin iptali ve dava sonuna kadar y\u00fcr\u00fctmenin durdurulmas\u0131 istemiyle dava a\u00e7\u0131lm\u0131\u015ft\u0131r. <\/p>\n<p>Davay\u0131 de\u011ferlendiren Samsun 3.\u0130dare Mahkemesi, 18.12.2019 tarihinde oy \u00e7oklu\u011fuyla verdi\u011fi karar ile i\u015flemi hukuka ayk\u0131r\u0131 bularak y\u00fcr\u00fctmesinin durdurulmas\u0131na h\u00fckmederken, <\/p>\n<p>\u2026 memurlarla ayn\u0131 i\u015fi yapsalar da 657 say\u0131l\u0131 Yasa gere\u011fince ayn\u0131 hukuksal durumda olmamalar\u0131 nedeniyle \u00f6zl\u00fck haklar\u0131n\u0131n farkl\u0131 olarak belirlenmesi m\u00fcmk\u00fcn olan s\u00f6zle\u015fmeli personelin istihdam ko\u015fullar\u0131 ile ilgili olarak, S\u00f6zle\u015fmeli Personel \u00c7al\u0131\u015ft\u0131r\u0131lmas\u0131na \u0130li\u015fkin Usul ve Esaslar\u2019da, 657 say\u0131l\u0131 Yasa\u2019n\u0131n memurlar i\u00e7in \u00f6ng\u00f6rd\u00fc\u011f\u00fc ko\u015fullardan farkl\u0131 d\u00fczenlemelere gidilmi\u015f, s\u00f6z konusu Esaslar\u2019da, bu Esaslarda h\u00fck\u00fcm bulunmamas\u0131 halinde 657 say\u0131l\u0131 Yasa\u2019n\u0131n memurlar i\u00e7in \u00f6ng\u00f6rd\u00fc\u011f\u00fc d\u00fczenlemelerin uygulanaca\u011f\u0131 yolunda bir h\u00fckme de yer verilmemi\u015ftir. Ancak, 657 say\u0131l\u0131 Yasa\u2019n\u0131n 4\/B maddesi ile ilgili uyu\u015fmazl\u0131klar\u0131n yarg\u0131 mercilerince \u00e7\u00f6z\u00fcm\u00fcnde, 657 say\u0131l\u0131 Yasa\u2019n\u0131n memurlarla ilgili h\u00fck\u00fcmleri do\u011frudan uygulanamasa bile, bu h\u00fck\u00fcmlerin referans olarak al\u0131nacak bir norm niteli\u011fi ta\u015f\u0131d\u0131\u011f\u0131 ku\u015fkusuzdur&#8230;Bu do\u011frultuda,..davac\u0131n\u0131n ba\u015fvurusunun ve ba\u015fvuruya esas al\u0131nan raporun 657 say\u0131l\u0131 Kanunun 105. maddesi ile Devlet Memurlar\u0131na Verilecek Hastal\u0131k Raporlar\u0131 ile Refakat \u0130znine \u0130li\u015fkin Usul ve Esaslar Hakk\u0131nda Y\u00f6netmeli\u011fin 10. maddesi h\u00fck\u00fcmlerinde yer verilen \u015fartlar \u00e7er\u00e7evesinde de\u011ferlendirilmek suretiyle uyu\u015fmazl\u0131\u011f\u0131n \u00e7\u00f6z\u00fclmesi gerekmektedir.<\/p>\n<p>diyerek ilk olarak davac\u0131n\u0131n hukuki stat\u00fcs\u00fc ortaya koyup referans norm olarak 657 say\u0131l\u0131 Kanun esas al\u0131narak karar verilmesi gereklili\u011fini ortaya koymu\u015ftur. <\/p>\n<p>Devam\u0131nda;<br \/>\nOtizm, k\u00fc\u00e7\u00fck ya\u015flarda ba\u015f g\u00f6steren geli\u015fimi, ileti\u015fimi ve etkile\u015fimi belirgin bi\u00e7imde etkileyen bir rahats\u0131zl\u0131k olup, ileti\u015fim ve etkile\u015fim bozuklu\u011funa sebep olan bu hastal\u0131\u011f\u0131n davran\u0131\u015f problemlerine de neden oldu\u011fu, otizmin neden kaynakland\u0131\u011f\u0131n\u0131n \u00f6\u011frenildikten sonra tedaviye en erken zaman i\u00e7inde ba\u015flanmas\u0131 gerekti\u011fi, e\u011fer otizm tan\u0131s\u0131 ve tedavisine bebeklik y\u0131llar\u0131nda ba\u015flanm\u0131\u015fsa ileride b\u00fcy\u00fcme ve ileti\u015fim becerilerinin normal d\u00fczeye kadar ula\u015fabilece\u011fi t\u0131bben bilinmekte olup, otizm hastal\u0131\u011f\u0131n\u0131n tedavisi olan bir hastal\u0131k olmas\u0131na ra\u011fmen bu tedavinin uzun y\u0131llar hatta hastan\u0131n ya\u015fam\u0131 boyu devam etmesi ve bebeklik d\u00f6nemindeki tedavisinin hastan\u0131n ilerleyen d\u00f6nemlerdeki ileti\u015fim ve sosyal becerileri \u00fczerindeki olumlu etkisi g\u00f6z \u00f6n\u00fcnde bulunduruldu\u011funda, refakat izni talebinde bulunan davac\u0131n\u0131n \u201cotizm\u201d te\u015fhisi konulan iki ya\u015f\u0131ndaki o\u011flu ile ilgili olarak d\u00fczenlenen Ondokuz May\u0131s \u00dcniversitesi Sa\u011fl\u0131k Uygulama Ara\u015ft\u0131rma Merkezi\u2019nin 16.09.2019 tarihli raporu ile Ondokuz May\u0131s \u00dcniversitesi Sa\u011fl\u0131k Uygulama Ara\u015ft\u0131rma Merkezi\u2019nin 13.09.2019 tarihli \u00f6zel gereksinim raporu birlikte de\u011ferlendirildi\u011finde, yukar\u0131da yer verilen mevzuat h\u00fck\u00fcmlerindeki \u015fartlar\u0131 ta\u015f\u0131d\u0131\u011f\u0131 g\u00f6r\u00fclmektedir.<\/p>\n<p>denilerek, otizm hastal\u0131\u011f\u0131n uzun y\u0131llar devam etmesi ve \u00e7ocu\u011fun ya\u015f\u0131 da g\u00f6zetildi\u011finde ileride b\u00fcy\u00fcme ve ileti\u015fim becerilerini geli\u015febilece\u011finin t\u0131bben ortaya konuldu\u011fu gibi bilimsel de\u011ferlendirmelere yer verilmi\u015ftir.<\/p>\n<p>Karar\u0131n bir di\u011fer \u00f6nemli yan\u0131 da; bir kad\u0131n\/anne olarak davac\u0131n\u0131n annelik ve aile hayat\u0131n\u0131n \u00e7al\u0131\u015fma hayat\u0131n\u0131n \u00f6n\u00fcne ge\u00e7mesi, \u00e7al\u0131\u015fma hakk\u0131n\u0131n k\u0131s\u0131tlanmas\u0131 anlam\u0131na gelen olumsuz durumun etkilerinden korumas\u0131 olmu\u015ftur.
