{"id":3769,"date":"2017-12-24T13:21:58","date_gmt":"2017-12-24T10:21:58","guid":{"rendered":"http:\/\/haksen.org.tr\/?p=3769"},"modified":"2017-12-24T13:41:50","modified_gmt":"2017-12-24T10:41:50","slug":"4cli-personelin-4bye-gecisi-nasil-olacak","status":"publish","type":"post","link":"https:\/\/haksen.org.tr\/?p=3769","title":{"rendered":"4\/C&#8217;li personelin 4\/B&#8217;ye ge\u00e7i\u015fi nas\u0131l olacak ?"},"content":{"rendered":"<p>Sendikam\u0131z\u0131n en ba\u015f\u0131ndan beri gerek hukuki gerekse demokratik anlamda kald\u0131r\u0131lmas\u0131 i\u00e7in verdi\u011fi m\u00fccadele sonucu 4\/C stat\u00fcs\u00fc tamamen kald\u0131r\u0131lm\u0131\u015ft\u0131r.<br \/>\nBu gelinen nokta \u00e7al\u0131\u015fma ya\u015fam\u0131m\u0131z a\u00e7\u0131s\u0131ndan tarihi bir durumdur.<br \/>\nElbette bu durum kendili\u011finden ortaya \u00e7\u0131kmam\u0131\u015ft\u0131r.<br \/>\nBu m\u00fccadeleyi y\u0131lmadan ve kararl\u0131l\u0131kla s\u00fcrd\u00fcren, i\u015ften \u00e7\u0131karmalar, her t\u00fcrl\u00fc bask\u0131 ve mobbinge ra\u011fmen HAKSEN&#8217;in hak ve emek m\u00fccadelesine destek olan sendika \u00fcyelerimiz olmak \u00fczere, y\u00f6netici ve temsilcilerimizi kutluyoruz.<br \/>\nYasal d\u00fczenlemenin yap\u0131lmas\u0131nda eme\u011fi ge\u00e7en herkese de te\u015fekk\u00fcr ediyoruz.<br \/>\nGeldi\u011fimiz bu noktadan itibaren hedefimiz t\u00fcm personelin kadrolu personel olmas\u0131d\u0131r.<br \/>\nHak ve emek m\u00fccadelemiz buradan devam edecektir.<\/p>\n<p><strong>4\/C MADDES\u0130 Y\u00dcR\u00dcRL\u00dcKTEN KALDIRILDI<\/strong><\/p>\n<p>657 say\u0131l\u0131 Yasan\u0131n 4\/C maddesine g\u00f6re \u00e7al\u0131\u015fmakta olan personel 4\/B s\u00f6zle\u015fmeli pozisyonlara ge\u00e7irilecek;<br \/>\n24 Aral\u0131k 2017 tarihinde Resmi Gazetede yay\u0131mlanan KHK ile 657 say\u0131l\u0131 Yasan\u0131n 4\/C maddesine g\u00f6re \u00e7al\u0131\u015fmakta olan ge\u00e7ici personel, 657 say\u0131l\u0131 Yasan\u0131n 4\/B maddesine g\u00f6re \u00e7al\u0131\u015ft\u0131r\u0131lmak \u00fczere s\u00f6zle\u015fmeli pozisyonlara nakledilecek.<br \/>\nKHK ile 657 say\u0131l\u0131 Yasan\u0131n 4\/C maddesi kanundan \u00e7\u0131kart\u0131lm\u0131\u015ft\u0131r. Buna g\u00f6re kamu kurum ve kurulu\u015flar\u0131nda 4\/C stat\u00fcs\u00fcnde personel istihdam edilmeyecektir.<\/p>\n<p><strong>K\u0130MLER 4\/B STAT\u00dcS\u00dcNE GE\u00c7\u0130R\u0130LECEK ?<\/strong><\/p>\n<p>-4 Aral\u0131k 2017 tarihi itibariyle halen 4\/C maddesine g\u00f6re \u00e7al\u0131\u015fmakta olanlar,<br \/>\n&#8211; Askerlik veya do\u011fum nedeniyle g\u00f6revlerinden ayr\u0131lm\u0131\u015f olanlar,<br \/>\n-\u00d6zelle\u015ftirme nedeniyle kamu ve \u00f6zel sekt\u00f6r i\u015fverenince s\u00f6zle\u015fmesi feshedilenler,<br \/>\n-Daha \u00f6ncesinde \u00f6zelle\u015ftirme nedeniyle 4\/C stat\u00fcs\u00fcne nakilde belirlenen s\u00fcreleri a\u015fanlar,<\/p>\n<p><strong>K\u0130MLER\u0130 KAPSAMIYOR ?<\/strong><\/p>\n<p>K\u0131smi zamanl\u0131 (tam g\u00fcn \u00e7al\u0131\u015fmayan) veya saat \u00fccreti kar\u015f\u0131l\u0131\u011f\u0131nda \u00e7al\u0131\u015fanlar,<\/p>\n<p><strong>GE\u00c7\u0130\u015eLER NE ZAMAN OLACAK ?<\/strong><\/p>\n<p>Ge\u00e7i\u015flerin 90 g\u00fcn i\u00e7erisinde yap\u0131lmas\u0131 gerekiyor.<\/p>\n<p><strong>GE\u00c7\u0130\u015eLER NASIL OLACAK ?<\/strong><\/p>\n<p>Ayn\u0131 kurumda ve birimde \u00e7al\u0131\u015ft\u0131r\u0131lmak \u00fczere Kurumun teklifi, Devlet Personel Ba\u015fkanl\u0131\u011f\u0131n\u0131n oluru ve Maliye Bakanl\u0131\u011f\u0131n\u0131n onay\u0131 ile ihdas edilecek s\u00f6zle\u015fmeli personel pozisyonlar\u0131na ge\u00e7irilecekler,<\/p>\n<p><strong>\u0130\u015e SONU TAZM\u0130NATI \u00d6DENECEK M\u0130 ?<\/strong><\/p>\n<p>4\/B stat\u00fcs\u00fcne ge\u00e7irilen personele i\u015f sonu tazminat\u0131 \u00f6denmeyecek.
