2017 y\u0131l\u0131 Bakanlar Kurulu karar\u0131nda yer alan 11 ay 28 g\u00fcn ibaresinin kald\u0131r\u0131larak, 4\/C\u2019li personelin <strong><u>kesintisiz olarak \u00e7al\u0131\u015ft\u0131r\u0131lmas\u0131n\u0131n<\/u><\/strong> sa\u011flanmas\u0131,<\/p>\n<p><strong>2-<\/strong>2017 y\u0131l\u0131 Bakanlar Kurulu karar\u0131n\u0131n 4&#8217;\u00fcnc\u00fc maddesinin 4 &#8216;\u00fcnc\u00fc f\u0131kras\u0131yla \u0130stanbul, Ankara ve \u0130zmir B\u00f6lge M\u00fcd\u00fcrl\u00fc\u011f\u00fcnde g\u00f6re yapan personele yap\u0131lan fazla \u00f6demenin di\u011fer B\u00f6lge M\u00fcd\u00fcrl\u00fcklerini de kapsayacak \u015fekilde d\u00fczenlenmesi,<\/p>\n<p><strong>3-<\/strong>Kurumda 4\/C stat\u00fcs\u00fcnde \u00e7al\u0131\u015fan personele ili\u015fkin 2017 Y\u0131l\u0131 Bakanlar Kurulu karar\u0131n\u0131n S\u00f6zle\u015fmesinin Sona Erece\u011fi halleri d\u00fczenleyen 8 inci maddesinde, Devlet Memurlar\u0131 Kanunun 125 inci maddesindeki Uyarma, K\u0131nama, Ayl\u0131ktan Kesme, Kademe \u0130lerlemesinin Durdurulmas\u0131 ve Memuriyetten \u00c7\u0131karmaya ili\u015fkin 27 fiil ve halleri s\u0131ralanarak;<\/p>\n<p><em>Bu bendin 1 ila 15 inci alt bentlerinde yer alan fiil ve hallerden herhangi birini bir s\u00f6zle\u015fme d\u00f6nemi i\u00e7inde \u00fc\u00e7 kez, 16 ila 27 inci alt bentlerinde yer alan fiil ve hallerden herhangi birini bir s\u00f6zle\u015fme d\u00f6nemi i\u00e7inde bir kez i\u015flendi\u011finin <u>tespit edilmesi<\/u> halinde s\u00f6zle\u015fme d\u00f6nemi bitimi beklemeksizin hemen sona erdirilir. <\/em>denilmektedir.<\/p>\n<p>S\u00f6z konusu d\u00fczenleme Devlet Memurlar\u0131 Kanununun Disiplin Cezas\u0131 gerektiren fiil ve hallerin ayn\u0131s\u0131 olmas\u0131na ra\u011fmen t\u00fcm cezalar s\u00f6zle\u015fme feshinin gerek\u00e7esi olarak uygulanmaktad\u0131r.<\/p>\n<p>Y\u00fcr\u00fct\u00fclen soru\u015fturma sonucuna g\u00f6re yap\u0131lan tespite dayanarak uygulanan cezalara herhangi bir itiraz hakk\u0131 da bulunmamaktad\u0131r.<\/p>\n<p>S\u00f6z konusu d\u00fczenlemenin y\u00fcr\u00fctmesi Dan\u0131\u015ftay 12.Dairesinin 2014\/4848 esas say\u0131l\u0131 karar\u0131 ile hukuka ayk\u0131r\u0131 bulunarak durdurulmu\u015ftur.<\/p>\n<p>Bu nedenle, yarg\u0131 karar\u0131n\u0131n gere\u011fi olarak, personelin s\u00fcbjektif \u00f6l\u00e7\u00fclerle dayanarak s\u00f6zle\u015fme feshinin \u00f6n\u00fcne ge\u00e7ilebilmesi ve kurumsal g\u00fcvenin sa\u011flanmas\u0131 i\u00e7in 657 say\u0131l\u0131 Yasa&#8217;da belirtilen h\u00fck\u00fcmlere paralel d\u00fczenleme yap\u0131lmas\u0131n\u0131,<\/p>\n<p><strong>4<\/strong>&#8211; Personelin Anayasal bir hakk\u0131 olan izinlerinin g\u00fcvenceye al\u0131nmas\u0131 ve farkl\u0131 uygulamalar\u0131n \u00f6n\u00fcne ge\u00e7ilebilmesi i\u00e7in 2017 Y\u0131l\u0131 Bakanlar Kurulu karar\u0131n\u0131n izinlere ili\u015fkin 10&#8217;uncu maddesinin 1\/a f\u0131kras\u0131n\u0131n;<\/p>\n<p><em>Ge\u00e7ici personele \u00e7al\u0131\u015ft\u0131klar\u0131 her ay i\u00e7in 2 g\u00fcn \u00fccretli izin verilir. <\/em><em>Bu izinler s\u00f6zle\u015fme d\u00f6nemi i\u00e7inde toplu olarak da kulland\u0131r\u0131labilir, \u015f<\/em>eklinde d\u00fczenlenmesi,<\/p>\n<p><strong><em>5<\/em><\/strong><strong>&#8211;<\/strong> Do\u011fum yapan personelin Annelik g\u00f6revini sa\u011fl\u0131kl\u0131 bir \u015fekilde yerine getirebilmesi i\u00e7in <strong><u>\u00fccretsiz izin<\/u><\/strong> hakk\u0131n\u0131 da i\u00e7erecek \u015fekilde d\u00fczenleme yap\u0131lmas\u0131,<\/p>\n<p><strong>6<\/strong>&#8211; 4\/C\u2019li Personelin bakmakla y\u00fck\u00fcml\u00fc oldu\u011fu aile fertlerinin hastal\u0131\u011f\u0131nda kullanabilmeleri i\u00e7in <strong><u>refakat izni<\/u><\/strong> verilmesi,<\/p>\n<p><strong>7<\/strong>&#8211; Askerlik nedeniyle istifa eden personelin <strong><u>askerlik d\u00f6n\u00fc\u015f\u00fc<\/u><\/strong> g\u00f6reve ba\u015flat\u0131lmalar\u0131 konusunda 657 say\u0131l\u0131 Yasa\u2019daki d\u00fczenlemeye uygun h\u00fck\u00fcm konulmas\u0131,<\/p>\n<p><strong>8<\/strong>&#8211;
