{"id":3423,"date":"2016-10-06T12:00:00","date_gmt":"2016-10-06T12:00:00","guid":{"rendered":"http:\/\/haksen.org.tr\/?p=3423"},"modified":"2016-10-06T12:00:00","modified_gmt":"2016-10-06T12:00:00","slug":"danistaydan-4-c-personele-mujdeli-haber-","status":"publish","type":"post","link":"https:\/\/haksen.org.tr\/?p=3423","title":{"rendered":"Dan\u0131\u015ftay&#8217;dan 4\/C personele m\u00fcjdeli haber"},"content":{"rendered":"<p>657 say\u0131l\u0131 Yasan\u0131n 4\/C maddesine g\u00f6re \u00e7al\u0131\u015f\u0131rken 2010 y\u0131l\u0131ndan \u00f6nce emekli olan veya istifa eden personele i\u015f sonu tazminat\u0131 \u00f6denmiyordu. <\/p>\n<p>Bunun \u00f6denmesi i\u00e7in sendika hukuk m\u00fc\u015favirli\u011fimiz taraf\u0131ndan a\u00e7\u0131lan birka\u00e7 davadan biri olan davada idare mahkemesinin ret karar\u0131na yap\u0131lan yap\u0131lana itiraz sonucu Dan\u0131\u015ftay idare mahkemesi karar\u0131n\u0131 bozmu\u015ftur.<\/p>\n<p>Konuyla ilgili hukuk m\u00fc\u015favirli\u011fimizin yapt\u0131\u011f\u0131 a\u00e7\u0131klama a\u015fa\u011f\u0131da sunulmu\u015ftur.<br \/>\n\u201cDan\u0131\u015ftay, 657 say\u0131l\u0131 Yasan\u0131n 4\/C maddesine g\u00f6re \u00e7al\u0131\u015f\u0131rken 2010 y\u0131l\u0131ndan \u00f6nce emekli olmu\u015f personele \u201c\u0130\u015f Sonu\u201d Tekel i\u015f\u00e7ilerinin eylemleri ile kamuoyu g\u00fcndemine gelen 657 say\u0131l\u0131 Devlet Memurlar\u0131 Kanunu\u2019nun (DMK) 4\/C bendine dayal\u0131 olarak kamuda istihdam edilen \u201cge\u00e7ici personel\u201dlerle ilgili kazan\u0131mlara bir yenisi daha eklendi. Dan\u0131\u015ftay 12.Dairesi\u2019nin 23.06.2016 tarihli yeni bir karar\u0131yla, 2009 y\u0131l\u0131nda emekli olan ancak i\u015f sonu tazminat\u0131 alamayan bir ge\u00e7ici personele tazminat \u00f6denmesi gerekti\u011fi, h\u00fck\u00fcm alt\u0131na al\u0131nd\u0131.<\/p>\n<p>Dava konu uyu\u015fmazl\u0131k, Elaz\u0131\u011f \u0130l Milli E\u011fitim M\u00fcd\u00fcrl\u00fc\u011f\u00fc b\u00fcnyesinde 4\/C\u2019li olarak \u00e7al\u0131\u015fan M.Y\u0131ld\u0131z\u2019\u0131n 2009 y\u0131l\u0131nda emekli olmas\u0131 sonras\u0131nda, kendisine i\u015f sonu tazminat\u0131 \u00f6denmesi i\u00e7in ba\u015fvuru yapmas\u0131 ile ba\u015flar. An\u0131lan tarihte 4\/C\u2019li ge\u00e7ici personele i\u015f sonu tazminat\u0131 \u00f6denmesi s\u00f6z konusu olmad\u0131\u011f\u0131ndan ba\u015fvurusu reddedilince de Elaz\u0131\u011f \u0130dare Mahkemesi\u2019nde dava a\u00e7\u0131l\u0131r.<br \/>\nElaz\u0131\u011f \u0130dare Mahkemesi taraf\u0131ndan 2011 y\u0131l\u0131nda davan\u0131n reddedilmesi \u00fczerine dosya Dan\u0131\u015ftay\u2019a gelir. Dan\u0131\u015ftay 12.Dairesi, yapt\u0131\u011f\u0131 de\u011ferlendirme sonucunda verdi\u011fi 23.06.2016 tarihli karar ile, \u00e7al\u0131\u015fan\u0131n tazminat hakk\u0131 bulundu\u011fu gerek\u00e7esiyle \u0130dare Mahkemesi ret karar\u0131n\u0131 bozar.(Y\u0131ld\u0131z Dan\u0131\u015ftay karar\u0131)<br \/>\nDan\u0131\u015ftay karar gerek\u00e7esinde;<\/p>\n<p>2010 y\u0131l\u0131ndan itibaren 4\/C stat\u00fcs\u00fcnde \u00e7al\u0131\u015fan ge\u00e7ici personele \u00f6denen i\u015f sonu tazminat\u0131n\u0131n devlet memuruna \u00f6denen emekli ikramiyesi ve i\u015f\u00e7ilere \u00f6dene k\u0131dem tazminat\u0131 niteli\u011finde bir \u00f6deme oldu\u011fu, her ne kadar davac\u0131n\u0131n emekli oldu\u011fu\/talepte bulundu\u011fu d\u00f6nemde bu tazminat\u0131n \u00f6denmesine dair d\u00fczenleme olmasa da uyu\u015fmazl\u0131\u011f\u0131n Anayasa\u2019n\u0131n 90 \u0131nc\u0131 maddesi gere\u011fi \u201canayasal ve evrensel hukuk normlar\u0131 ba\u011flam\u0131nda de\u011ferlendirilmesi\u201d gerekti\u011fi, e\u015fit davranma ilkesi vb temel ilkeler de g\u00f6zetilerek, 4\/C\u2019li ge\u00e7ici personele i\u015f sonu tazminat\u0131 \u00f6denmesi zorunlulu\u011fu,<br \/>\na\u00e7\u0131k\u00e7a ifade edilmi\u015ftir.<\/p>\n<p>Devam etmekte olan bir ka\u00e7 davadan birisi olan Y\u0131ld\u0131z dosyas\u0131nda verilen bu karar, y\u0131llarca 4\/C stat\u00fcs\u00fcnde \u00e7al\u0131\u015fm\u0131\u015f ve 2010 y\u0131l\u0131ndan \u00f6nce emekli olmu\u015f ve\/veya i\u015f sonu tazminat\u0131 almaya hak kazanacak \u015fekilde i\u015ften ayr\u0131lm\u0131\u015f (zaman a\u015f\u0131m\u0131 s\u00fcresi dikkate al\u0131narak) t\u00fcm personele ba\u015fvuru ve dava hakk\u0131 do\u011furacak gibi g\u00f6r\u00fcnmektedir. Zira, yarg\u0131 karar\u0131yla ortaya \u00e7\u0131kan yeni durum \u00e7er\u00e7evesinde, idareye ba\u015fvurarak istemde bulunmak, reddi \u00fczerine de dava a\u00e7mak m\u00fcmk\u00fcnd\u00fcr.<\/p>\n<p>Elbette ki do\u011frusu, bu durumda olan \u00e7al\u0131\u015fanlar\u0131n haklar\u0131n\u0131n ba\u015fvuru \u00fczerine do\u011frudan \u00f6denmesi, gereksiz bir yarg\u0131 s\u00fcreci ile kamu zarar\u0131na neden olunmamas\u0131d\u0131r. Zira, Dan\u0131\u015ftay karar\u0131, var olan hakk\u0131n kabul edilmesi niteli\u011finde olup, hak sahiplerinin yarg\u0131 s\u00fcreci sonunda haklar\u0131na ula\u015fmas\u0131 b\u00fcy\u00fck bir olas\u0131l\u0131kt\u0131r. Benzeri yarg\u0131 s\u00fcre\u00e7lerinin de hak sahipleri lehine geli\u015fti\u011fini d\u00fc\u015f\u00fcnd\u00fc\u011f\u00fcm\u00fczde, hukuka sayg\u0131l\u0131 bir idare anlay\u0131\u015f\u0131 ile hareket edilmesi, olu\u015fan hakl\u0131 beklentinin kar\u015f\u0131lanmas\u0131 yerinde olacakt\u0131r.<br \/>\nBu ve benzeri kararlar, ciddi meselelerde sorunlar\u0131 hal\u0131n\u0131n alt\u0131na s\u00fcp\u00fcrmenin sadece g\u00fcn\u00fc kurtard\u0131\u011f\u0131n\u0131, biriken meselelerin b\u00fcy\u00fcyerek yine kar\u015f\u0131m\u0131za \u00e7\u0131kt\u0131\u011f\u0131n\u0131 da g\u00f6stermektedir. ..
