{"id":3222,"date":"2015-06-11T12:00:00","date_gmt":"2015-06-11T12:00:00","guid":{"rendered":"http:\/\/haksen.org.tr\/?p=3222"},"modified":"2015-06-11T12:00:00","modified_gmt":"2015-06-11T12:00:00","slug":"danistay--tuikde-kolelige-dur--dedi","status":"publish","type":"post","link":"https:\/\/haksen.org.tr\/?p=3222","title":{"rendered":"Dan\u0131\u015ftay, T\u00dc\u0130K&#8217;de K\u00f6leli\u011fe Dur, Dedi"},"content":{"rendered":"<p>DANI\u015eTAY, T\u00dc\u0130K&#8217;DE K\u00d6LEL\u0130\u011eE DUR,  DED\u0130.<\/p>\n<p>B\u00fcro Hak-Sen&#8217;in a\u00e7t\u0131\u011f\u0131 dava sonucu Dan\u0131\u015ftay ,T\u00fcrkiye \u0130statistik Kurumu&#8217;nda 657 say\u0131l\u0131 Yasan\u0131n 4\/c maddesine g\u00f6re \u00e7al\u0131\u015fan personelin mali ve sosyal haklar\u0131n\u0131 d\u00fczenleyen Bakanlar Kurulu karar\u0131n\u0131n i\u015ften \u00e7\u0131karma, izin ve fazla \u00e7al\u0131\u015fmas\u0131na ili\u015fkin \u00f6nemli bir karara imza att\u0131.<\/p>\n<p>B\u00fcro \u00c7al\u0131\u015fanlar\u0131 Hak Sendikas\u0131 (B\u00fcro Hak-Sen) taraf\u0131ndan  Bakanlar Kurulu karar\u0131ndaki hukuka ayk\u0131r\u0131 h\u00fck\u00fcmlerin iptali i\u00e7in a\u00e7\u0131lan davada, Dan\u0131\u015ftay 12.Dairesi ,  T\u00dc\u0130K&#8217;de \u00e7al\u0131\u015fan 4\/C personelin s\u00f6zle\u015fme feshini , fazla \u00e7al\u0131\u015fma \u00fccreti ve y\u0131ll\u0131k izinleri d\u00fczenleyen maddelerin y\u00fcr\u00fctmesinin durdurulmas\u0131na karar verdi.<\/p>\n<p>KANUNLA VER\u0130LEN \u0130LAVE \u00d6DEME FAZLA \u00c7ALI\u015eMA \u00dcCRET\u0130  SAYILMAZ.<br \/>\n 5429 say\u0131l\u0131 T\u00fcrkiye \u0130statistik Kanunun 49 uncu maddesinin 3 \u00fcnc\u00fc f\u0131kras\u0131nda yer alan; <\/p>\n<p> 657 say\u0131l\u0131 Devlet Memurlar\u0131 Kanununun 4 \u00fcnc\u00fc maddesinin (C) f\u0131kras\u0131na g\u00f6re s\u00f6zle\u015fmeli olarak \u00e7al\u0131\u015ft\u0131r\u0131lacak ge\u00e7ici personele, ayr\u0131ca en y\u00fcksek Devlet  memuru ayl\u0131\u011f\u0131n\u0131n (ek g\u00f6sterge dahil) %20&#8217;si oran\u0131nda \u00f6deme yap\u0131l\u0131r ve bu \u00f6deme damga vergisi hari\u00e7 herhangi bir vergiye tabi tutulamaz,<\/p>\n<p>h\u00fckm\u00fc ile T\u00fcrkiye \u0130statistik Kurumunda \u00e7al\u0131\u015fan 4\/C&#8217;li personele ayl\u0131k \u00fccretine ilave olarak ( g\u00fcncel tutar\u0131  150 TL )  \u00f6deme yap\u0131lmas\u0131 gerekmektedir.<\/p>\n<p>Ancak, Bakanlar Kurulu karar\u0131n\u0131n 4 \u00fcnc\u00fc maddesinin 6 nc\u0131 f\u0131kras\u0131nda;<br \/>\nGe\u00e7ici personele, 5429 say\u0131l\u0131 Kanunun 49 uncu maddesinin \u00fc\u00e7\u00fcnc\u00fc f\u0131kras\u0131nda belirtilen tutarda fazla \u00e7al\u0131\u015fma \u00fccreti \u00f6denir. Bu \u00f6deme damga vergisi hari\u00e7 herhangi bir vergiye tabi tutulamaz. \u00d6denen bu \u00fccret g\u00fcnl\u00fck normal \u00e7al\u0131\u015fma saatlerini a\u015fan s\u00fcreler i\u00e7in yap\u0131lan fiili fazla \u00e7al\u0131\u015fman\u0131n da kar\u015f\u0131l\u0131\u011f\u0131d\u0131r.<\/p>\n<p>denilmek suretiyle, Kanunla verilen ilave \u00fccret, fiilen yap\u0131lan fazla \u00e7al\u0131\u015fma \u00fccreti olarak da \u00f6denmektedir.<\/p>\n<p>Sendikam\u0131z taraf\u0131ndan a\u00e7\u0131lan davada s\u00f6z konusu \u00f6demenin Kanunla verilmesi gereken zorunlu bir \u00f6deme oldu\u011fu, bu nedenle fiilen yap\u0131lan fazla \u00e7al\u0131\u015fman\u0131n kar\u015f\u0131l\u0131\u011f\u0131n\u0131n ayr\u0131ca \u00f6denmesi gerekti\u011fi, Bakanlar Kurulu karar\u0131ndaki;<\/p>\n<p>&#8230;.\u00d6denen bu \u00fccret g\u00fcnl\u00fck normal \u00e7al\u0131\u015fma saatlerini a\u015fan s\u00fcreler i\u00e7in yap\u0131lan fiili fazla \u00e7al\u0131\u015fman\u0131n da kar\u015f\u0131l\u0131\u011f\u0131d\u0131r.<\/p>\n<p>ibaresinin \u00f6ncelikle y\u00fcr\u00fctmesinin durdurulmas\u0131 ve iptali istenmi\u015ftir.<br \/>\nDan\u0131\u015ftay 12.Dairesi, Kanunla verilen ilave \u00f6demenin fiilen yap\u0131lan Fazla \u00c7al\u0131\u015fman\u0131n kar\u015f\u0131l\u0131\u011f\u0131 olamayaca\u011f\u0131, d\u00fczenlemenin \u00dclkemizin imzalad\u0131\u011f\u0131 29 nolu \u0130LO S\u00f6zle\u015fmesinin 1 inci maddesine , Anayasam\u0131z\u0131n &#8220;Zorla \u00c7al\u0131\u015ft\u0131rma  Yasa\u011f\u0131na&#8221; ve 657 say\u0131l\u0131 Yasan\u0131n 178 inci maddesine ayk\u0131r\u0131 oldu\u011funu, 4\/C personele yapt\u0131klar\u0131 fiili fazla \u00e7al\u0131\u015fma kar\u015f\u0131l\u0131\u011f\u0131nda \u00fccret veya izin verilmesi gerekti\u011fini belirterek;<\/p>\n<p>&#8230;.\u00d6denen bu \u00fccret g\u00fcnl\u00fck normal \u00e7al\u0131\u015fma saatlerini a\u015fan s\u00fcreler i\u00e7in yap\u0131lan fiili fazla \u00e7al\u0131\u015fman\u0131n da kar\u015f\u0131l\u0131\u011f\u0131d\u0131r.<\/p>\n<p>ibaresinin y\u00fcr\u00fctmesini durdurmu\u015ftur.<\/p>\n<p>Bu kararla, T\u00fcrkiye \u0130statistik Kurumunda \u00e7al\u0131\u015fan 4\/C personele ilave \u00fccret \u00f6denmesinin yan\u0131nda, fiilen yapt\u0131klar\u0131 Fazla \u00c7al\u0131\u015fman\u0131n kar\u015f\u0131l\u0131\u011f\u0131nda \u00fccret yada izin verilecektir.<\/p>\n<p>   h\u00fckm\u00fcn\u00fcn Bakanlar Kurulu karar\u0131 ile fazla \u00e7al\u0131\u015fma \u00fccretine d\u00f6n\u00fc\u015ft\u00fcr\u00fclmesinin  hukuka ayk\u0131r\u0131 oldu\u011funa  ve personele ayr\u0131ca Fazla \u00c7al\u0131\u015fma \u00fccreti \u00f6denmesi gerekti\u011fine karar verdi.<\/p>\n<p>Sendikam\u0131z fazla \u00e7al\u0131\u015fma yapan \u00fcyelerimizin yasal haklar\u0131 i\u00e7in gerekli giri\u015fimleri yapacakt\u0131r.<\/p>\n<p>4\/C PERSONEL\u0130N S\u00d6ZLE\u015eME FESH\u0130NE \u0130L\u0130\u015eK\u0130N MADDELER HUKUKA AYKIRI.<\/p>\n<p>Bilindi\u011fi gibi, T\u00fcrkiye \u0130statistik Kurumunda g\u00f6rev yapan personelin S\u00f6zle\u015fmesinin Sona Erece\u011fi halleri d\u00fczenleyen Bakanlar Kurulu Karar\u0131n\u0131n 8 inci maddesinde;<\/p>\n<p>Devlet Memurlar\u0131 Kanunun 125 inci maddesindeki Uyarma, K\u0131nama, Ayl\u0131ktan Kesme, Kademe \u0130lerlemesinin Durdurulmas\u0131 ve Memuriyetten \u00c7\u0131karmaya ili\u015fkin  27 fiil ve halleri s\u0131ralayarak;<\/p>\n<p>Bu bendin 1 ila 15 inci alt bentlerinde yer alan fiil ve hallerden herhangi birini bir s\u00f6zle\u015fme d\u00f6nemi  i\u00e7inde iki kez, 16 ila 27 inci alt bentlerinde yer alan fiil ve hallerden herhangi birini bir s\u00f6zle\u015fme d\u00f6nemi i\u00e7inde bir kez i\u015flendi\u011finin tespit edilmesi halinde s\u00f6zle\u015fme d\u00f6nemi bitimi beklemeksizin hemen sona erdirilir.<\/p>\n<p>denilmektedir.<\/p>\n<p>S\u00f6z konusu d\u00fczenleme Devlet Memurlar\u0131 Kanununun Disiplin Cezas\u0131 gerektiren fiil ve hallerin ayn\u0131s\u0131 olmas\u0131na ra\u011fmen , t\u00fcm cezalar s\u00f6zle\u015fme feshinin gerek\u00e7esi olarak uygulanmaktad\u0131r.<\/p>\n<p>\u00d6rne\u011fin, Uyarma cezas\u0131 gerektiren bir fiilin iki defa tespit edilmesi durumunda dahi personelin s\u00f6zle\u015fmesi feshedilmektedir.<\/p>\n<p>\u00dcstelik , s\u00f6z konusu cezalara ili\u015fkin i\u015flemler 657 say\u0131l\u0131 Yasa&#8217;da belirtilen savunma ve Disiplin Kurulu itiraz hakk\u0131 bulunmadan keyfi olarak yap\u0131lmaktad\u0131r.<\/p>\n<p>Bu nedenle, istenilen personelin s\u00f6zle\u015fmesi  tek tarafl\u0131 tespitlerle feshedilmekte, personel psikolojik bask\u0131 alt\u0131nda tutulmaktad\u0131r.<\/p>\n<p>Bu maddeler nedeniyle herhangi bir itiraz hakk\u0131 olmadan, Disiplin Kurulu karar\u0131 al\u0131nmadan Ankara B\u00f6lge M\u00fcd\u00fcrl\u00fc\u011f\u00fcnde 17 personelin s\u00f6zle\u015fmesi feshedilmi\u015ftir. Di\u011fer B\u00f6lge M\u00fcd\u00fcrl\u00fcklerinde de baz\u0131 personel bu y\u00fczden i\u015ften \u00e7\u0131kar\u0131lm\u0131\u015ft\u0131r.<\/p>\n<p>Sendikam\u0131z\u0131n a\u00e7t\u0131\u011f\u0131 davada , \u0130dareye verilen bu  s\u0131n\u0131rs\u0131z yetkinin hukuka ayk\u0131r\u0131 oldu\u011fu ve \u00f6ncelikle y\u00fcr\u00fctmesinin durdurulmas\u0131 ve iptali istenmi\u015ftir.<br \/>\nDan\u0131\u015ftay 12.Dairesi;<\/p>\n<p>Bu bendin 1 ila 15 inci alt bentlerinde yer alan fiil ve hallerden herhangi birini bir s\u00f6zle\u015fme d\u00f6nemi  i\u00e7inde iki kez, 16 ila 27 inci alt bentlerinde yer alan fiil ve hallerden herhangi birini bir s\u00f6zle\u015fme d\u00f6nemi i\u00e7inde bir kez i\u015flendi\u011finin tespit edilmesi halinde s\u00f6zle\u015fme d\u00f6nemi bitimi beklemeksizin hemen sona erdirilir.<\/p>\n<p>h\u00fckm\u00fcn\u00fcn 657 say\u0131l\u0131 Yasan\u0131n 125. maddesinde d\u00fczenlenen uyarma, k\u0131nama, ayl\u0131ktan kesme, kademe ilerlemesinin durdurulmas\u0131 ve Devlet memurlu\u011fundan \u00e7\u0131karma cezas\u0131n\u0131 gerektiren fiil ve haller aras\u0131nda yer ald\u0131\u011f\u0131 belirtilen Dan\u0131\u015ftay karar\u0131nda;  d\u00fczenlemede yer alan fiil ve hallerin a\u011f\u0131rl\u0131k bak\u0131m\u0131ndan Devlet memurlu\u011fundan \u00e7\u0131karma cezas\u0131n\u0131 gerektirmeyecek nitelikte fiil ve haller olmas\u0131 nedeniyle \u00f6l\u00e7\u00fcl\u00fcl\u00fck ilkesine ayk\u0131r\u0131l\u0131k te\u015fkil etti\u011fi ve hakkaniyete uygun olmad\u0131\u011f\u0131, belirtildi.<\/p>\n<p>KARAR \u0130LE ZARI ZARF ESARET\u0130 VE ZULM\u00dc SONA ERECEKT\u0130R.<\/p>\n<p>Bu karar gere\u011fince, 4\/C personel de 657 say\u0131l\u0131 Devlet Memurlar\u0131 Kanununu uyar\u0131nca Disiplin H\u00fck\u00fcmlerine tabi olacakt\u0131r. Art\u0131k, kimse g\u00f6nderilen zar\u0131 zarflar\u0131n esiri olmayacakt\u0131r.
