{"id":3218,"date":"2015-06-02T12:00:00","date_gmt":"2015-06-02T12:00:00","guid":{"rendered":"http:\/\/haksen.org.tr\/?p=3218"},"modified":"2015-06-02T12:00:00","modified_gmt":"2015-06-02T12:00:00","slug":"civituik-4-cliye-yargi-yoluyla-is-guvencesi","status":"publish","type":"post","link":"https:\/\/haksen.org.tr\/?p=3218","title":{"rendered":"\u00c7ivi:T\u00fcik 4\/C&#8217;liye Yarg\u0131 Yoluyla \u0130\u015f G\u00fcvencesi"},"content":{"rendered":"<p>T\u00fcrkiye \u0130statistik Kurumu&#8217;nda 657 say\u0131l\u0131 Yasan\u0131n 4\/C maddesine g\u00f6re \u00e7al\u0131\u015fan personel i\u00e7in Dan\u0131\u015ftay 12.Dairesi \u00f6nemli bir karar\u0131n alt\u0131na imza att\u0131.<br \/>\nB\u00fcro \u00c7al\u0131\u015fanlar\u0131 Hak Sendikas\u0131 (B\u00fcro Hak-Sen) taraf\u0131ndan a\u00e7\u0131lan davada, Dan\u0131\u015ftay 12.Dairesi 4\/C stat\u00fcs\u00fcndeki personel a\u00e7\u0131s\u0131ndan 657 say\u0131l\u0131 Yasan\u0131n referans norm olarak de\u011ferlendirilmesi gerekti\u011fi gerek\u00e7esiyle \u0130dare Mahkemesi karar\u0131n\u0131 oy birli\u011fiyle bozdu.<br \/>\nT\u00dc\u0130K&#8217;de 4\/C stat\u00fcs\u00fcnde \u00e7al\u0131\u015f\u0131rken  &#8220;Uyarma&#8221; cezas\u0131 ald\u0131\u011f\u0131 gerek\u00e7esiyle s\u00f6zle\u015fmesi feshedilen sendika \u00fcyesinin  g\u00f6reve iadesi i\u00e7in a\u00e7\u0131lan davan\u0131n olumlu sonu\u00e7lanm\u0131\u015f, ancak kurum ilgili personelin s\u00f6zle\u015fmesini yenilememi\u015fti.<br \/>\nBunun \u00fczerine sendika taraf\u0131ndan a\u00e7\u0131lan ikinci davan\u0131n idare mahkemesince reddedilmesi \u00fczerine Dan\u0131\u015ftay&#8217;a yap\u0131lan temyiz ba\u015fvurusu sonucu Dan\u0131\u015ftay 12.Dairesi  idare mahkemesi karar\u0131n\u0131 bozdu.<br \/>\nDan\u0131\u015ftay karar\u0131nda; 4\/C stat\u00fcs\u00fcndeki personelle ilgili d\u00fczenleme yapma yetkisinin Bakanlar Kurulu&#8217;nda oldu\u011fu ancak 657 say\u0131l\u0131 Yasa&#8217;da yer alan d\u00fczenlemelerin referans norm olarak al\u0131nmas\u0131nda hukuken bir engel bulunmad\u0131\u011f\u0131, belirtilmi\u015ftir.<\/p>\n<p>Kararda; Davac\u0131n\u0131n hizmetine ihtiya\u00e7 duyulmad\u0131\u011f\u0131 hususunun hukuken kabul edilebilir bi\u00e7imde net olarak ortaya konulmad\u0131\u011f\u0131,aksine daval\u0131 idarenin yapt\u0131\u011f\u0131 i\u015f nedeniyle her zaman ge\u00e7ici personele ihtiyac\u0131 bulundu\u011funu a\u00e7\u0131k\u00e7a ifade etti\u011fi de g\u00f6r\u00fclmektedir, denilmektedir.<\/p>\n<p>Dan\u0131\u015ftay 12.Dairesi,  mevcut s\u00fcregelen uygulamas\u0131 bak\u0131m\u0131ndan 4\/C kapsam\u0131nda bulunan t\u00fcm personelin ge\u00e7ici ve s\u00fcrekli i\u015flerde istihdam edildi\u011fi, bu nedenle de s\u00f6zle\u015fme s\u00fcresinin bitiminde s\u00f6zle\u015fmesinin yenilenmesi konusunda idarelerin geni\u015f takdir yetkisinin bulundu\u011funu s\u00f6ylemek m\u00fcmk\u00fcn de\u011fildir, diyerek idare mahkemesi karar\u0131n\u0131 bozmu\u015ftur.<\/p>\n<p>T\u00dc\u0130K Y\u00d6NET\u0130M\u0130 HUKUKU \u00c7\u0130\u011eNEMEYE DEVAM ED\u0130YOR.<\/p>\n<p>Haksen Genel Ba\u015fkan\u0131 Ayhan \u00c7ivi kararla ilgili yapt\u0131\u011f\u0131 de\u011ferlendirmede, s\u00f6z konusu karar\u0131n hukuka ayk\u0131r\u0131 bi\u00e7imde keyfi olarak s\u00f6zle\u015fmesi feshedilen di\u011fer personel i\u00e7in de \u00f6nemli bir g\u00fcvence olaca\u011f\u0131n\u0131, s\u00f6yledi.<\/p>\n<p>\u00c7ivi, \u00e7e\u015fitli gerek\u00e7elerle s\u00f6zle\u015fmesi feshedilen sendika \u00fcyelerimiz ad\u0131na a\u00e7t\u0131\u011f\u0131m\u0131z davalar\u0131 kazanmam\u0131za ra\u011fmen T\u00dc\u0130K y\u00f6netimi hukuku \u00e7i\u011fneyerek personeli g\u00f6revine iade etmemektedir.
