{"id":2933,"date":"2014-07-25T12:00:00","date_gmt":"2014-07-25T12:00:00","guid":{"rendered":"http:\/\/haksen.org.tr\/?p=2933"},"modified":"2014-07-25T12:00:00","modified_gmt":"2014-07-25T12:00:00","slug":"torba-yasadaki-4-c-duzenlemesi-","status":"publish","type":"post","link":"https:\/\/haksen.org.tr\/?p=2933","title":{"rendered":"Torba Yasa\u2019daki 4\/C D\u00fczenlemesi"},"content":{"rendered":"<p>Halen TBMM\u2019de g\u00f6r\u00fc\u015fmeleri devam eden Torba Yasa\u2019ya eklenen bir madde ile \u00d6zelle\u015ftirme sonucu kamu veya \u00f6zel sekt\u00f6rde \u00e7al\u0131\u015fmaya devam eden kamu i\u015f\u00e7ilerinin de 4\/C stat\u00fcs\u00fcnde \u00e7al\u0131\u015ft\u0131r\u0131lmas\u0131 imk\u00e2n\u0131 verilmi\u015ftir.<\/p>\n<p>Kamuoyuna yans\u0131d\u0131\u011f\u0131 \u015fekilde halen 4\/C stat\u00fcs\u00fcnde \u00e7al\u0131\u015fan personeli ilgilendiren bir d\u00fczenleme olmay\u0131p,  \u00f6zelle\u015ftirilen kamu i\u015fletmelerini sat\u0131n alan \u015firkette \u00e7al\u0131\u015fmaya devam ederken i\u015f akitleri feshedilen i\u015f\u00e7ileri ilgilendirmektedir.<\/p>\n<p>2004\/7898 say\u0131l\u0131 \u00d6zelle\u015ftirme Uygulamalar\u0131 Sonucunda \u0130\u015fsiz Kalan ve Bilahare \u0130\u015fsiz Kalacak Olan \u0130\u015f\u00e7ilerin Di\u011fer Kamu Kurum ve Kurulu\u015flar\u0131nda Ge\u00e7ici Personel Stat\u00fcs\u00fcnde \u0130stihdam Edilmelerine \u0130li\u015fkin Esaslar\u0131 d\u00fczenleyen Bakanlar Kurulu Karar\u0131nda; <\/p>\n<p>\u201c\u00d6zelle\u015ftirme program\u0131ndaki kurulu\u015flarda \u00e7al\u0131\u015fanlardan, i\u015fletmelerinin \u00f6zelle\u015ftirilmesi sonras\u0131nda, bu i\u015fletmelerde \u00e7al\u0131\u015fmaya devam eden ve \u00f6zelle\u015ftirme tarihinden itibaren en ge\u00e7 alt\u0131 ay i\u00e7inde i\u015f akitleri \u00f6zel sekt\u00f6r taraf\u0131ndan feshedilenler de bu maddedeki \u015fartlar ve esaslar \u00e7er\u00e7evesinde istihdam edilirler. Bu t\u00fcrden personelin bu haktan yararlanabilmesi i\u00e7in, i\u015f akitlerinin feshedilmesini m\u00fcteakip 30 g\u00fcn i\u00e7inde bizzat veya \u00e7al\u0131\u015ft\u0131klar\u0131 \u015firket kanal\u0131yla EK-I&#8217;de yer alan formla \u00d6zelle\u015ftirme \u0130daresi Ba\u015fkanl\u0131\u011f\u0131na m\u00fcracaat etmeleri gerekmektedir.\u201d<\/p>\n<p>Denilmektedir.Buna g\u00f6re, i\u015fletmesi sat\u0131lan ve i\u015f akitleri feshedilen ki\u015filerin ilk alt\u0131 ayl\u0131k s\u00fcrede 4\/C stat\u00fcs\u00fcne ge\u00e7ebilme haklar\u0131 mevcuttu. 6 ayl\u0131k s\u00fcreden sonra i\u015f akitleri feshedilenlerin bu haklar\u0131 ortadan kalkm\u0131\u015f oluyordu.<\/p>\n<p>Torba Yasa\u2019da a\u015fa\u011f\u0131daki d\u00fczenleme ile bu i\u015f\u00e7ilerin de s\u00fcre \u015fart\u0131 olmadan 4\/C\u2019ye ge\u00e7ebilmelerine imkan veriliyor.<\/p>\n<p>TORBA YASA\u2019YA EKLENEN MADDE METN\u0130;<\/p>\n<p>MADDE 14 &#8211; 14\/7\/1965 tarihli ve 657 say\u0131l\u0131 Devlet Memurlar\u0131 Kanununun 4 \u00fcnc\u00fc maddesinin (C) f\u0131kras\u0131na a\u015fa\u011f\u0131daki paragraf eklenmi\u015ftir. <\/p>\n<p>&#8220;\u00d6zelle\u015ftirme uygulamalar\u0131 sebebiyle i\u015f akitleri kamu veya \u00f6zel sekt\u00f6r i\u015fverenince feshedilen ve 24\/11\/1994 tarihli ve 4046 say\u0131l\u0131 Kanun kapsam\u0131nda di\u011fer kamu kurum ve kurulu\u015flar\u0131na nakil hakk\u0131 bulunmayan personel de bu f\u0131kra kapsam\u0131nda ya\u015fl\u0131l\u0131k veya malull\u00fck ayl\u0131\u011f\u0131 almaya hak kazan\u0131ncaya kadar istihdam edilebilir.
