Yaz\u0131n\u0131n ekinde g\u00f6nderilen rapor a\u015fa\u011f\u0131da sunulmu\u015ftur.<\/p>\n<p>I-TESP\u0130TLER\u0130M\u0130Z<br \/>\nA- \u00c7ALI\u015eMA STAT\u00dcS\u00dcNDEK\u0130  ANAYASA\u2019YA AYKIRILIK<\/p>\n<p>10.11.2005 g\u00fcnl\u00fc 5429 say\u0131l\u0131 T\u00fcrkiye \u0130statistik Kanunu ile verilen g\u00f6revleri yerine getirmekte olan T\u00fcrkiye \u0130statistik Kurumu Ba\u015fkanl\u0131\u011f\u0131nda   657 say\u0131l\u0131 Yasa\u2019n\u0131n 4\/c maddesi uyar\u0131nca  1477 adet personel ge\u00e7ici olarak \u00e7al\u0131\u015ft\u0131r\u0131lmaktad\u0131r. Bu say\u0131 kurumun toplam personelinin  y\u00fczde 46\u2019s\u0131na denk gelmektedir.<\/p>\n<p>Ge\u00e7ici personel olarak adland\u0131r\u0131lmalar\u0131na ra\u011fmen \u00e7e\u015fitli hizmet s\u00fcrelerinde olmak \u00fczere 25 y\u0131ld\u0131r kurumda \u00e7al\u0131\u015fan personel bulunmaktad\u0131r.<\/p>\n<p>Kurumun halen y\u00fcr\u00fctmekte oldu\u011fu s\u00fcrekli  hizmetlerin her a\u015famas\u0131nda kadrolu personelle birlikte \u00e7al\u0131\u015fmalar\u0131na ra\u011fmen stat\u00fcleri ge\u00e7ici personel olarak tan\u0131mlanmaktad\u0131r.<\/p>\n<p>Bu husus  Anayasam\u0131z\u0131n 128 nci maddesindeki ;<\/p>\n<p> Devletin, kamu iktisad\u00ee te\u015febb\u00fcsleri ve di\u011fer kamu t\u00fczelki\u015filerinin genel idare esaslar\u0131na g\u00f6re y\u00fcr\u00fctmekle y\u00fck\u00fcml\u00fc olduklar\u0131 kamu hizmetlerinin gerektirdi\u011fi asl\u00ee ve s\u00fcrekli g\u00f6revler, memurlar ve di\u011fer kamu g\u00f6revlileri eliyle g\u00f6r\u00fcl\u00fcr.<\/p>\n<p>h\u00fckm\u00fcne de ayk\u0131r\u0131l\u0131k te\u015fkil etmektedir.  25 y\u0131ldan beri \u00e7al\u0131\u015fan bir personelin nas\u0131l hala ge\u00e7ici olarak tan\u0131mland\u0131\u011f\u0131 ne akl\u0131n ne de hukukun kabul edece\u011fi bir durum de\u011fildir.<\/p>\n<p>B- GE\u00c7\u0130C\u0130 PERSONELE YAPILAN YASAL  AYRIMCILIK<\/p>\n<p>4.4.2007 tarihinde TBMM\u2019de kabul edilerek y\u00fcr\u00fcrl\u00fc\u011fe giren 5620 say\u0131l\u0131 Yasa ile  ida\u00adre\u00adler\u00adde fab\u00adri\u00adka, \u015fan\u00adti\u00adye, at\u00f6l\u00adye, \u00e7ift\u00adlik, ara\u00adzi gi\u00adbi i\u015f\u00ad\u00e7i is\u00adtih\u00adda\u00adm\u0131\u00adn\u0131n zo\u00adrun\u00adlu ol\u00addu\u00ad\u011fu yer\u00adler\u00adde i\u015f\u00ad\u00e7i\u00adler eliy\u00adle g\u00f6r\u00add\u00fc\u00adr\u00fcl\u00adme\u00adsi ge\u00adre\u00adken i\u015f\u00adler\u00adde fii\u00adlen \u00e7a\u00adl\u0131\u00ad\u015fan\u00adlar s\u00fc\u00adrek\u00adli i\u015f\u00ad\u00e7i kad\u00adro\u00adla\u00adr\u0131\u00adna, bun\u00adla\u00adr\u0131n d\u0131\u00ad\u015f\u0131n\u00adda ka\u00adlan ge\u00ad\u00e7i\u00adci i\u015f\u00ad\u00e7i\u00adler ise is\u00adtek\u00adle\u00adri h\u00e2lin\u00adde 14\/7\/1965 ta\u00adrih\u00adli ve  657 sa\u00ady\u0131\u00adl\u0131 Dev\u00adlet Me\u00admur\u00adla\u00adr\u0131 Ka\u00adnu\u00adnu\u00adnun 4 \u00fcn\u00adc\u00fc mad\u00adde\u00adsi\u00adnin (B) f\u0131k\u00adra\u00ads\u0131 h\u00fc\u00adk\u00fcm\u00adle\u00adri uya\u00adr\u0131n\u00adca s\u00f6z\u00adle\u015f\u00adme\u00adli per\u00adso\u00adnel po\u00adzis\u00adyon\u00adla\u00adr\u0131\u00adna ge\u00e7i\u015fleri sa\u011flanm\u0131\u015ft\u0131r. Yakla\u015f\u0131k 230 bin ge\u00e7ici kamu i\u015f\u00e7isi bu haktan yararlan\u0131rken, y\u0131llardan beri TU\u0130K\u2019te g\u00f6rev yapan 1477 ge\u00e7ici kamu personeli kapsam d\u0131\u015f\u0131nda tutulmu\u015ftur.<\/p>\n<p>C- TU\u0130K\u2019\u0130N BA\u015eARISINDAK\u0130 PAYI<\/p>\n<p>T\u00fcrkiye \u0130statistik Kurumunca verilen \u00e7e\u015fitli hizmetlerin yan\u0131nda , TU\u0130K personelinin b\u00fcy\u00fck  \u00f6zveri ve gayretleri sonucunda olu\u015fturulan Adrese Dayal\u0131 N\u00fcfus Kay\u0131t Sistemi \u00fclkemiz a\u00e7\u0131sndan \u00f6v\u00fcn\u00e7 kayna\u011f\u0131 olmu\u015ftur. Pek \u00e7ok kamu hizmetinin sunumu ve denetimini \u00f6ng\u00f6ren bu sistem olu\u015fturulmas\u0131nda kadrolu personel gibi i ge\u00e7ici personel de  b\u00fcy\u00fck pay \u00f6l\u00e7\u00fcde pay sahibi olmu\u015ftur..  TU\u0130K\u2019in misyonu ve vizyonunun ayr\u0131lmaz bir par\u00e7as\u0131 haline gelen ge\u00e7ici personelin \u00fcvey evlatl\u0131ktan kurtulmas\u0131 gerekmektedir.<\/p>\n<p>D- SEND\u0130KAL AYRIMCILIK<\/p>\n<p> 4688 say\u0131l\u0131 Kamu G\u00f6revlileri Sendikalar\u0131 Kanununda belirtilen yasaklar d\u0131\u015f\u0131nda kalan  657 say\u0131l\u0131 Yasa\u2019ya tabi t\u00fcm kamu g\u00f6revlileri  sendika hakk\u0131na sahip olurken, Yasa\u2019da  herhangi bir yasak bulunmamas\u0131na ra\u011fmen ge\u00e7ici personelin sendika \u00fcyeli\u011fi kabul edilmemektedir.<\/p>\n<p>4688 say\u0131l\u0131 Yasan\u0131n Kapsam maddesinde;<\/p>\n<p>Bu Kanun, Devletin veya di\u011fer kamu t\u00fczel ki\u015filerinin y\u00fcr\u00fctmekle g\u00f6revli olduklar\u0131 kamu hizmetlerinin g\u00f6r\u00fcld\u00fc\u011f\u00fc genel, katma ve \u00f6zel b\u00fct\u00e7eli idareler, il \u00f6zel idareleri ve belediyeler ile bunlara ba\u011fl\u0131 kurulu\u015flarda kamu iktisad\u00ee te\u015febb\u00fcslerinde, \u00f6zel kanunlarla veya \u00f6zel kanunlar\u0131n verdi\u011fi yetkiye dayanarak kurulan banka ve te\u015fekk\u00fcller ile bunlara ba\u011fl\u0131 kurulu\u015flarda ve di\u011fer kamu kurum veya kurulu\u015flar\u0131nda i\u015f\u00e7i stat\u00fcs\u00fc d\u0131\u015f\u0131nda \u00e7al\u0131\u015fan kamu g\u00f6revlileri hakk\u0131nda uygulan\u0131r.<\/p>\n<p>H\u00fckm\u00fcne g\u00f6re  i\u015f\u00e7i stat\u00fcs\u00fc d\u0131\u015f\u0131ndaki t\u00fcm kamu g\u00f6revlileri kapsam i\u00e7ine al\u0131nm\u0131\u015f olmas\u0131na ra\u011fmen ge\u00e7ici personel \u00f6rg\u00fctlenme hakk\u0131ndan mahrum b\u0131rak\u0131lmaktd\u0131r.<\/p>\n<p>E-SOSYAL HAKLARDAK\u0130  AYRIMCILIK<\/p>\n<p>1-       Ekonomik ve sosyal haklar\u0131 y\u00f6n\u00fcnden\u0131 Devlet memuru say\u0131lmad\u0131klar\u0131 halde Devlet memurlar\u0131 i\u00e7in su\u00e7 say\u0131lan fiil ve hareketler ile di\u011fer yapt\u0131r\u0131mlara tabidirler.<\/p>\n<p>2-      Kendilerine verilen g\u00f6revleri mesai saatine bak\u0131lmaks\u0131n\u0131z bitirmekle y\u00fck\u00fcml\u00fcd\u00fcrler.Mesai saatleri d\u0131\u015f\u0131nda veya tatil g\u00fcnleri yapacaklar\u0131 \u00e7al\u0131\u015fmalar nedeniyle herhangi bir \u00fccret \u00f6denmemektedir.<\/p>\n<p>3-      Devlet memurlar\u0131  10 y\u0131la kadar 20 g\u00fcn, 10 y\u0131ldan sonras\u0131 i\u00e7in 30 g\u00fcn \u00fccretli y\u0131ll\u0131k  izin kullan\u0131rken, ge\u00e7ici personelin y\u0131ll\u0131k en fazla 12 g\u00fcn \u00fccretli izin hakk\u0131 bulunmaktad\u0131r.<\/p>\n<p>4-      Devlet memurlar\u0131na verilen  s\u0131hhi izinlerde bir y\u0131lda 7 g\u00fcn\u00fc a\u015fan k\u0131sm\u0131 i\u00e7in  sadece   zam ve tazminatlar\u0131n\u0131n  y\u00fczde 25\u2019 kesilirken, ge\u00e7ici personele her  4 ay i\u00e7in en fazla 2 g\u00fcn \u00fccretli s\u0131hhi izin verilmekte, 2 g\u00fcn\u00fc a\u015fan k\u0131s\u0131mlar\u0131 i\u00e7in hi\u00e7bir \u00fccret \u00f6denmemektedir.<\/p>\n<p>5-      Kadin memura dogum yapmasindan once 3 hafta ve dogum yaptigi tarihten itibaren 6 hafta s\u00fcreyle \u00fccretli  izin veriliken, ge\u00e7ici kad\u0131n personelin do\u011fum yapmas\u0131 halinde herhangi bir \u00fccretli izin hakk\u0131 bulunmamaktad\u0131r.<\/p>\n<p>6-      S\u00f6zle\u015fmenin feshi i\u00e7in (hi\u00e7 bir objektif kriter konulmadan tamamen) birim amirlerinin ba\u015far\u0131s\u0131z bulmas\u0131 yeterli  say\u0131lmaktad\u0131r.<\/p>\n<p>7-      S\u00f6zle\u015fmenin feshi halinde ge\u00e7ici personele herhangi bir ihbar, k\u0131dem ve sair \u00f6deme yap\u0131lmamaktad\u0131r.<\/p>\n<p>F-EKONOM\u0130K HAKLARDAK\u0130 AYRIMCILIK<\/p>\n<p>1-      \u00dcniversite mezunu , 11 y\u0131l hizmeti olan bekar bir Devlet memuru yakla\u015f\u0131k 900 ytl maa\u015f al\u0131rken,  \u00fcniversite mezunu ve 11 y\u0131ld\u0131r \u00e7al\u0131\u015fan ge\u00e7ici personelin maa\u015f\u0131 (112 ytl fazla \u00e7al\u0131\u015fma ek \u00f6demesi dahil)  627 ytl dir.<\/p>\n<p>2-      Lise mezunu 6 y\u0131l hizmeti olan bekar bir Devlet  memuru yakla\u015f\u0131k 856 ytl maa\u015f al\u0131rken , lise mezunu ve 6 y\u0131ld\u0131r \u00e7al\u0131\u015fan ge\u00e7ici personelin maa\u015f\u0131 ( 112 ytl fazla \u00e7al\u0131\u015fma ek \u00f6demesi dahil) 582 ytl dir.<\/p>\n<p> Yukar\u0131daki \u00fccretler dikkate al\u0131nd\u0131\u011f\u0131nda kadrolu personel ile ayn\u0131 tahsil ve hizmet s\u00fcresine sahip olan ge\u00e7ici personelin maa\u015f\u0131 1\/3 oran\u0131nda d\u00fc\u015f\u00fckt\u00fcr. Ayn\u0131 i\u015fi yapan personelin stat\u00fcs\u00fcnden kaynaklanan bu fark nedeniyle,  personelin y\u00fczde 46\u2019s\u0131  TU\u0130K\u2019in a\u00e7\u0131klad\u0131\u011f\u0131 yoksulluk s\u0131n\u0131r\u0131n\u0131n alt\u0131nda bulunmaktad\u0131r.<\/p>\n<p>*T\u00fcrkiye \u0130statistik Kurumundaki personelin y\u00fczde 46\u2019s\u0131 ge\u00e7ici olarak \u00e7al\u0131\u015ft\u0131r\u0131lmaktad\u0131r.<\/p>\n<p>II- TALEB\u0130M\u0130Z<\/p>\n<p>59.H\u00fck\u00fcmet taraf\u0131ndan 21.5.2004 tarihinde TBMM\u2019ye g\u00f6nderilen T\u00fcrkiye \u0130statistik Kanunu Tasar\u0131s\u0131n\u0131n Ge\u00e7ici 9.Maddesinde;  ge\u00e7ici personelden uygun \u015fartlar\u0131 ta\u015f\u0131yanlar\u0131n iki y\u0131l\u0131n\u0131 doldurmu\u015f olmalar\u0131 halinde asaleten,  aksi takdirde aday memur olarak atanmalar\u0131 \u00f6ng\u00f6r\u00fclm\u00fc\u015f olmas\u0131na ra\u011fmen, bu madde TBMM\u2019deki alt  komisyonda tasar\u0131 metninden \u00e7\u0131kar\u0131lm\u0131\u015ft\u0131r.
