{"id":1871,"date":"2011-12-14T12:00:00","date_gmt":"2011-12-14T12:00:00","guid":{"rendered":"http:\/\/haksen.org.tr\/?p=1871"},"modified":"2011-12-14T12:00:00","modified_gmt":"2011-12-14T12:00:00","slug":"maliye-bakanligina-4-c-basvurusu","status":"publish","type":"post","link":"https:\/\/haksen.org.tr\/?p=1871","title":{"rendered":"Maliye Bakanl\u0131\u011f\u0131na 4\/C Ba\u015fvurusu"},"content":{"rendered":"<p>Kamu \u00c7al\u0131\u015fanlar\u0131 Hak Sendikalar\u0131 Konfederasyonu (HAKSEN), 657 say\u0131l\u0131 Yasan\u0131n 4\/C maddesine g\u00f6re \u00e7al\u0131\u015fan personelin \u00e7al\u0131\u015fma \u015fartlar\u0131nda iyile\u015ftirme yap\u0131lmas\u0131 i\u00e7in Maliye Bakanl\u0131\u011f\u0131na ba\u015fvurdu.<\/p>\n<p>HAKSEN Genel Ba\u015fkan\u0131 Ayhan \u00c7ivi taraf\u0131ndan yap\u0131lan yaz\u0131l\u0131 ba\u015fvuruda;  4\/C\u2019li personelin hak kayb\u0131na neden olan hukuka ayk\u0131r\u0131 d\u00fczenlemelerin , 2012 y\u0131l\u0131nda Kamu Kurum ve Kurulu\u015flar\u0131ndaki Ge\u00e7ici Mahiyetteki \u0130\u015fleri Y\u00fcr\u00fctmek \u00dczere Ge\u00e7ici Personel \u0130stihdam\u0131 ve Bu Personele \u00d6denecek \u00dccretler Hakk\u0131nda Kararda d\u00fczeltilmesi talep edildi.<\/p>\n<p>Konfederasyondan yap\u0131lan a\u00e7\u0131klamaya g\u00f6re; gerek T\u00fcrkiye \u0130statistik Kurumu gerekse de \u00d6zelle\u015ftirme Nedeniyle nakledilen personelle ilgili olarak Maliye Bakanl\u0131\u011f\u0131nca \u00fczerinde \u00e7al\u0131\u015f\u0131lan  2012 y\u0131l\u0131 Bakanlar Kurulu karar\u0131nda d\u00fczeltilmesi istenen hususlar \u015f\u00f6yle s\u0131raland\u0131;<\/p>\n<p>1)- 657 say\u0131l\u0131 Yasan\u0131n 4\/C personel \u00e7al\u0131\u015ft\u0131r\u0131lmas\u0131na ili\u015fkin ilgili kararlarda yer verilen, \u201cge\u00e7ici personele bu kararda belirtilen \u00fccretler d\u0131\u015f\u0131nda herhangi bir ad alt\u0131nda \u00f6deme yap\u0131lamaz ve hizmet s\u00f6zle\u015fmelerine bu y\u00f6nde h\u00fck\u00fcm konulamaz\u201d ibaresinin metinden \u00e7\u0131kar\u0131larak, ge\u00e7ici personelin fiilen yapt\u0131\u011f\u0131 g\u00f6rev nedeniyle hak etti\u011fi ek \u00f6deme, fazla \u00e7al\u0131\u015fma, ek ders, d\u00f6ner sermaye vb. \u00f6demelerin yap\u0131lmas\u0131n\u0131n sa\u011flanmas\u0131,<\/p>\n<p>2)- 6111 say\u0131l\u0131 Yasan\u0131n 83 \u00fcnc\u00fc maddesinin (b) bendiyle \u201c Kamu kurum ve kurulu\u015flar\u0131n\u0131n merkez ve ta\u015fra te\u015fkilat\u0131 ile d\u00f6ner sermaye i\u015fletmelerinin kadrolar\u0131nda ve s\u00f6zle\u015fmeli personel pozisyonlar\u0131nda istihdam edilen s\u00f6zle\u015fmeli personel ile yap\u0131lan hizmet s\u00f6zle\u015fmeleri\u201d  Damga Vergisinden muaf tutulmu\u015ftur.<br \/>\nBu nedenle, 657 say\u0131l\u0131 Yasan\u0131n 4\/C maddesine \u00e7al\u0131\u015fan s\u00f6zle\u015fmeli personel ile yap\u0131lan hizmet s\u00f6zle\u015fmelerinin Damga Vergisinden muaf tutulmas\u0131,<\/p>\n<p>3)- T\u00fcrkiye \u0130statistik Kurumunda 4\/C\u2019li personel \u00e7al\u0131\u015ft\u0131r\u0131lmas\u0131 hakk\u0131ndaki 2011 y\u0131l\u0131na ili\u015fkin Bakanlar Kurulu Karar\u0131nda yer alan S\u00f6zle\u015fmenin Sona Erece\u011fi Hallere \u0130li\u015fkin 8 inci maddedeki;<\/p>\n<p>a)Devlet memurlar\u0131 i\u00e7in kanun, t\u00fcz\u00fck ve y\u00f6netmeliklerde su\u00e7 say\u0131lan ve\/veya disipline ayk\u0131r\u0131 fiil ve hareketleri i\u015fledi\u011finin tespit edilmesi,<\/p>\n<p>b)G\u00f6revinde ba\u015far\u0131s\u0131z oldu\u011funun birim amirlerince tespit edilmesi,<br \/>\nH\u00fck\u00fcmleri gerek\u00e7e g\u00f6sterilmek suretiyle uyar\u0131, k\u0131nama vb. disiplin cezas\u0131 verilen 4\/C personelin s\u00f6zle\u015fmesi, disiplin cezalar\u0131n\u0131n yarg\u0131sal denetimi dahi beklenmeden feshedilmektedir. Di\u011fer bir deyi\u015fle s\u00f6zle\u015fme feshi de bir nevi disiplin cezas\u0131 \u015feklinde uygulanmaktad\u0131r.<\/p>\n<p>Bu i\u015fleme maruz kalan sendika \u00fcyelerimiz ad\u0131na Kastamonu, Erzurum ve Antalya \u0130dare Mahkemelerine a\u00e7\u0131lan davalar lehte sonu\u00e7lanm\u0131\u015f olup, mahkeme kararlar\u0131 ekte sunulmu\u015ftur.<\/p>\n<p>\u0130dare mahkemelerinin kararlar\u0131nda genel olarak;<br \/>\n \u201cKamu hizmetini y\u00fcr\u00fcten memurlar\u0131n ya da kamu g\u00f6revlisi say\u0131lan kimselerin i\u015fledikleri fiiller nedeniyle cezaland\u0131r\u0131lmalar\u0131 gereken durumlarda bireysel \u00f6zg\u00fcrl\u00fckler ve insan haklar\u0131 normlar\u0131 ile \u00e7at\u0131\u015fmamas\u0131na \u00f6zen g\u00f6sterilmek yan\u0131nda; \u00f6l\u00e7\u00fcl\u00fcl\u00fck ilkesinin bir gere\u011fi olarak su\u00e7 ile onun kanunda g\u00f6sterilen cezas\u0131 aras\u0131nda hakkaniyette tesis edilmesi gerekti\u011fi belitilen mahkeme karar\u0131nda; &#8220;Fiil ile ceza aras\u0131nda bulunmas\u0131 zorunlu olan \u00f6l\u00e7\u00fcl\u00fcl\u00fck ve adil dengenin olmad\u0131\u011f\u0131 kanaatine var\u0131ld\u0131\u011f\u0131ndan, davac\u0131n\u0131n hizmet s\u00f6zle\u015fmesinin feshine ili\u015fkin dava konusu i\u015flemde hukuka uyarl\u0131k bulunmad\u0131\u011f\u0131 sonucuna var\u0131lm\u0131\u015ft\u0131r&#8221; denilmektedir.<\/p>\n<p>Bu nedenle, Bakanlar Kurulu karar\u0131nda yer alan \u201cS\u00f6zle\u015fmenin Sona Erece\u011fi Hallere\u201d ili\u015fkin d\u00fczenlemenin hukuka uygun olacak \u015fekilde d\u00fczenlemesini,<\/p>\n<p>4)-  6111 say\u0131l\u0131 Yasan\u0131n  106 nc\u0131 maddesiyle de\u011fi\u015fik 657 say\u0131l\u0131 Yasan\u0131n 104 \u00fcnc\u00fc maddesinin (B) f\u0131kras\u0131nda,   Memura, e\u015finin do\u011fum yapmas\u0131 h\u00e2linde, iste\u011fi \u00fczerine on g\u00fcn babal\u0131k izni; kendisinin veya \u00e7ocu\u011funun evlenmesi ya da e\u015finin, \u00e7ocu\u011funun, kendisinin veya e\u015finin ana, baba ve karde\u015finin \u00f6l\u00fcm\u00fc h\u00e2llerinde iste\u011fi \u00fczerine yedi g\u00fcn izin verilir,<\/p>\n<p>(D) f\u0131kras\u0131nda , Kad\u0131n memura,  \u00e7ocu\u011funu  emzirmesi  i\u00e7in  do\u011fum  sonras\u0131  anal\u0131k  izni s\u00fcresinin bitim tarihinden itibaren ilk alt\u0131 ayda g\u00fcnde \u00fc\u00e7 saat, ikinci alt\u0131 ayda g\u00fcnde birbu\u00e7uk saat s\u00fct izni verilir, h\u00fckm\u00fc getirilmi\u015ftir.<\/p>\n<p>Bu nedenle, 657 say\u0131l\u0131 Yasa\u2019da yap\u0131lan de\u011fi\u015fikliklerden  657 say\u0131l\u0131 Yasan\u0131n 4\/C maddesine g\u00f6re  \u00e7al\u0131\u015fan personelin de yararlanmas\u0131 i\u00e7in gerekli de\u011fi\u015fikli\u011fin yap\u0131larak,<\/p>\n<p>a)4\/C li personelin y\u0131lba\u015f\u0131nda yap\u0131lan i\u015f s\u00f6zle\u015fmesinden do\u011fan 22 g\u00fcnl\u00fck y\u0131ll\u0131k izin haklar\u0131n\u0131n y\u0131l i\u00e7erisinde taleplerine g\u00f6re kulland\u0131r\u0131lmas\u0131,<\/p>\n<p>b)4\/C\u2019li personelin e\u015finin do\u011fum yapmas\u0131 h\u00e2linde, iste\u011fi \u00fczerine on g\u00fcn babal\u0131k izni;
