Ayr\u0131ca, 6111 say\u0131l\u0131 Torba Yasa&#8217;n\u0131n 118&#8217;inci maddesi ile 375 say\u0131l\u0131 KHK&#8217;ya eklenen ek 8&#8217;nci maddesinde yer alan &#8220;s\u00f6zle\u015fmeli personel pozisyonlar\u0131nda&#8221; ibaresinin iptali i\u00e7in itiraz yoluyla Anayasa Mahkemesine ba\u015fvuru yap\u0131lmas\u0131 da talep edildi. <\/p>\n<p>Sendika \u00fcyesi 4\/C&#8217;liler ad\u0131na Dan\u0131\u015ftay&#8217;a yap\u0131lan ba\u015fvuru dilek\u00e7esinde, birbirleriyle ayn\u0131 durumda olanlara ayr\u0131 kurallar\u0131n uygulanmas\u0131n\u0131n Anayasa&#8217;n\u0131n 10. maddesindeki e\u015fitlik ilkesine ayk\u0131r\u0131 oldu\u011fu, ayn\u0131 \u015fekilde Avrupa Konseyi Bakanlar Komitesince kabul edilen \u0130yi \u0130dare Konusunda \u00dcye Devletlere Tavsiye Karar\u0131 hat\u0131rlat\u0131larak, ayn\u0131 hukuki stat\u00fcde bulunan ki\u015filer aras\u0131nda &#8220;nesnel \u00f6l\u00e7\u00fctlere dayal\u0131 olmayan&#8221; farkl\u0131 uygulama yap\u0131lmas\u0131n\u0131n s\u00f6z konusu karar\u0131n e\u015fitlik ilkesine ayk\u0131r\u0131 olaca\u011f\u0131 belirtildi. <\/p>\n<p>-&#8220;4\/B VE 4\/C G\u00dcVENCES\u0130Z \u00c7ALI\u015eTIRMANIN DAYANA\u011eI OLARAK ALGILANIYOR&#8221;- <\/p>\n<p>Dava dilek\u00e7esinde; 657 say\u0131l\u0131 yasan\u0131n 4\/B ve 4\/C bentlerinde varolan h\u00fck\u00fcmlerin, bug\u00fcn itibariyle, g\u00fcvencesiz \u00e7al\u0131\u015ft\u0131rman\u0131n dayana\u011f\u0131 olarak alg\u0131land\u0131\u011f\u0131 ifade edilerek, iki farkl\u0131 stat\u00fc gibi g\u00f6r\u00fcnmesine ra\u011fmen, bug\u00fcn uygulamas\u0131nda s\u00f6zle\u015fmeli personel ile ge\u00e7ici personel aras\u0131nda maddi\/hukuki bir ayr\u0131m\u0131n bulunmad\u0131\u011f\u0131 vurguland\u0131. Dilek\u00e7ede ayr\u0131ca pek \u00e7ok Dan\u0131\u015ftay karar\u0131 ile bu iki stat\u00fcn\u00fcn Anayasan\u0131n 128. maddesinde belirtilen &#8220;di\u011fer personel&#8221; olarak kabul edilebilece\u011fi ortaya konularak, iki stat\u00fcye tabi \u00e7al\u0131\u015fanlar\u0131n da 4688 say\u0131l\u0131 Kamu G\u00f6revlileri Sendikalar\u0131na \u00fcye olacaklar\u0131, ayn\u0131 i\u00e7erikteki &#8220;i\u015f sonu tazminat\u0131 hakk\u0131na sahip olduklar\u0131&#8221;n\u0131n h\u00fck\u00fcm alt\u0131na al\u0131nd\u0131\u011f\u0131 belirtildi. <\/p>\n<p>Dilek\u00e7ede, 4\/C stat\u00fcs\u00fcnde \u00e7al\u0131\u015fan ge\u00e7ici personelin de, t\u0131pk\u0131 4\/B stat\u00fcs\u00fcndeki s\u00f6zle\u015fmeli personel gibi, hemen hemen ayn\u0131 h\u00fck\u00fcmleri i\u00e7erir idari hizmet s\u00f6zle\u015fmelerine dayal\u0131 olarak \u00e7al\u0131\u015ft\u0131r\u0131lmakta oldu\u011fu belirtilerek, bu \u00e7er\u00e7evede, ayn\u0131 sendikaya \u00fcye olan, ayn\u0131 haklara sahip k\u0131l\u0131nan s\u00f6zle\u015fmeli personel ile ge\u00e7ici personel aras\u0131nda, aile yard\u0131m\u0131 a\u00e7\u0131s\u0131ndan farkl\u0131l\u0131k getirilmesi ile s\u00f6zle\u015fmeli personele tan\u0131nan aile yard\u0131m\u0131n\u0131n ge\u00e7ici personele tan\u0131nmamas\u0131n\u0131n, maddi ve hukuki temeli bulunmayan bir ayr\u0131mc\u0131l\u0131k g\u00f6stergesi oldu\u011funun alt\u0131 \u00e7izildi.<\/p>\n<p>-&#8220;4\/C&#8217;L\u0130LERE NEGAT\u0130F AYRIMCILIK DEVAM ED\u0130YOR&#8221;- <\/p>\n<p>HAKSEN Genel Ba\u015fkan\u0131 Ayhan \u00c7ivi, ANKA&#8217;ya yapt\u0131\u011f\u0131 a\u00e7\u0131klamada s\u00f6zle\u015fmeli personele yap\u0131lmaya ba\u015flanan aile yard\u0131m\u0131n\u0131n 4\/C&#8217;li personele \u00f6denmemesini negatif ayr\u0131mc\u0131l\u0131k olarak nitelendirdi. \u00c7ivi, s\u00fcrekli kamu hizmetlerinde g\u00f6revlendirilen 4\/C&#8217;li personelin, g\u00f6rev ve sorumluluklar\u0131 y\u00f6n\u00fcnden 657 say\u0131l\u0131 Yasa&#8217;ya tabi k\u0131l\u0131n\u0131rken, ekonomik ve sosyal haklar\u0131n\u0131n verilmedi\u011fini ifade ederek, &#8220;4\/C&#8217;li personel de her y\u0131l yenilenen i\u015f s\u00f6zle\u015fmesiyle \u00e7al\u0131\u015ft\u0131r\u0131lmaktad\u0131r. Ancak, Maliye Bakanl\u0131\u011f\u0131 4\/C&#8217;li personelin s\u00f6zle\u015fmelerinden Damga Vergisi almas\u0131na ra\u011fmen, onlar\u0131 s\u00f6zle\u015fmeli personel olarak kabul etmiyor. Bu \u00e7ifte standartt\u0131r.
