{"id":1149,"date":"2010-09-28T12:00:00","date_gmt":"2010-09-28T12:00:00","guid":{"rendered":"http:\/\/haksen.org.tr\/?p=1149"},"modified":"2010-09-28T12:00:00","modified_gmt":"2010-09-28T12:00:00","slug":"saglikta-ogle-mesai-uygulamasi-hukuka-aykiri","status":"publish","type":"post","link":"https:\/\/haksen.org.tr\/?p=1149","title":{"rendered":"Sa\u011fl\u0131kta \u00d6\u011fle Mesai Uygulamas\u0131 Hukuka Ayk\u0131r\u0131"},"content":{"rendered":"<p>Kamu \u00c7al\u0131\u015fanlar\u0131 Hak Sendikalar\u0131 Konfederasyonu (HakSen) Genel Ba\u015fkan\u0131 Ayhan \u00c7ivi ve Sa\u011fl\u0131k Hak-Sen Genel Ba\u015fkan\u0131 Selahattin Karaca imzas\u0131 ile Sa\u011fl\u0131k Bakanl\u0131\u011f\u0131na yap\u0131lan ba\u015fvuruda sa\u011fl\u0131k \u00e7al\u0131\u015fanlar\u0131n\u0131n \u00f6\u011fle tatili sorununun \u00e7\u00f6z\u00fclmesi istendi.<\/p>\n<p>Yap\u0131lan ba\u015fvuruya ili\u015fkin bir a\u00e7\u0131klama yapan Genel Ba\u015fkan Ayhan \u00c7ivi, 30 Temmuz\u2019da y\u00fcr\u00fcrl\u00fc\u011fe giren Tam G\u00fcn Yasas\u0131na g\u00f6re sa\u011fl\u0131k \u00e7al\u0131\u015fanlar\u0131n\u0131n haftal\u0131k \u00e7al\u0131\u015fma s\u00fcresinin 40 saat olarak belirlendi\u011fini hat\u0131rlatarak, mevzuatta yap\u0131lan de\u011fi\u015fikli\u011fe ra\u011fmen kesintisiz hizmet verilmesi gereken sa\u011fl\u0131k birimlerinde fiilen bu uygulaman\u0131n yap\u0131lmas\u0131n\u0131n m\u00fcmk\u00fcn olmad\u0131\u011f\u0131n\u0131 s\u00f6yledi.<\/p>\n<p>Sa\u011fl\u0131k Bakanl\u0131\u011f\u0131n\u0131n yay\u0131mlad\u0131\u011f\u0131 genelgede; sa\u011fl\u0131k kurumlar\u0131nda personelin \u00f6\u011fle yeme\u011fi ve istirahat\u0131 i\u00e7in saat 12-13 aras\u0131 \u00f6\u011fle tatili olarak ayr\u0131lmas\u0131 esast\u0131r. Ancak hizmetin kesintisiz olarak s\u00fcrd\u00fcr\u00fclmesi gereken birimlerde \u00f6\u011fle tatili saatinde de yeterli say\u0131da personel bulundurulur. Bu s\u00fcre i\u00e7inde hizmet veren personele yemek ve dinlenme i\u00e7in kurum idaresince uygun g\u00f6r\u00fclen zamanda bir saatlik \u00f6\u011fle tatili verilir, denildi\u011fini belirten HakSen Genel Ba\u015fkan\u0131 Ayhan \u00c7ivi, bunun zorlama bir d\u00fczenleme oldu\u011funu, idari kadroda g\u00f6rev yapan personelin d\u0131\u015f\u0131ndaki sa\u011fl\u0131k \u00e7al\u0131\u015fanlar\u0131 a\u00e7\u0131s\u0131ndan fiilen yap\u0131lan uygulaman\u0131n personeli ma\u011fdur etmeye devam edece\u011fini s\u00f6yledi.<\/p>\n<p>Sa\u011fl\u0131k \u00e7al\u0131\u015fanlar\u0131na yap\u0131lan d\u00f6ner sermaye ek \u00f6demesinin yasal izinlerinde kesilmesi nedeniyle  personelin yasal izin haklar\u0131n\u0131 dahi kullanamaz duruma geldi\u011fini vurgulayan \u00c7ivi, maalesef personel ek \u00f6deme veya  izin tercihine zorlanarak  robot haline getirilmi\u015ftir, \u015fimdi de s\u00f6zde \u00f6\u011fle tatili uygulamas\u0131 ile eskiden oldu\u011fu gibi 45 saat \u00e7al\u0131\u015fmak zorunda kalacaklar, dedi.<\/p>\n<p>\u00c7ivi a\u00e7\u0131klamas\u0131na \u015f\u00f6yle devam etti;<br \/>\nYatakl\u0131 Tedavi Kurumlar\u0131 \u0130\u015fletme Y\u00f6netmeli\u011fine g\u00f6re mesai saatleri d\u0131\u015f\u0131ndaki t\u00fcm hizmetlerin n\u00f6bet esas\u0131na g\u00f6re yap\u0131lmas\u0131 gerekirken, idareye keyfiyet yetkisi veren, sa\u011fl\u0131k \u00e7al\u0131\u015fanlar\u0131n\u0131n hak kayb\u0131na neden olacak bir genelge ile yap\u0131lan d\u00fczenleme hukuka ayk\u0131r\u0131d\u0131r. Bunun i\u00e7in sa\u011fl\u0131k bakanl\u0131\u011f\u0131na gerekli ba\u015fvurumuzu yapt\u0131k. <\/p>\n<p>D\u00fczenlemenin usul ve esaslar\u0131n\u0131n n\u00f6bet esas\u0131na g\u00f6re yap\u0131lmas\u0131n\u0131 talep ettik.
