{"id":1140,"date":"2010-09-20T12:00:00","date_gmt":"2010-09-20T12:00:00","guid":{"rendered":"http:\/\/haksen.org.tr\/?p=1140"},"modified":"2010-09-20T12:00:00","modified_gmt":"2010-09-20T12:00:00","slug":"candogan-uyeler-adina-basvuruya-engel-yok","status":"publish","type":"post","link":"https:\/\/haksen.org.tr\/?p=1140","title":{"rendered":"Cando\u011fan: \u00dcyeler ad\u0131na ba\u015fvuruya engel yok"},"content":{"rendered":"<p>HAKSEN Hukuk M\u00fc\u015faviri Av.G\u00f6khan Cando\u011fan, referandum sonucu kabul edilen Anayasa de\u011fi\u015fikli\u011fine g\u00f6re sendikalar\u0131n \u00fcyeleri ad\u0131na yarg\u0131ya ba\u015fvuru yapmalar\u0131n\u0131 engelleyen bir h\u00fck\u00fcm bulunmad\u0131\u011f\u0131n\u0131 belirtti.<\/p>\n<p>Cando\u011fan \u015fu g\u00f6r\u00fc\u015fleri dile getirdi;<\/p>\n<p>5982 say\u0131l\u0131 yasa ile Anayasan\u0131n baz\u0131 h\u00fck\u00fcmlerinin de\u011fi\u015ftirilmesi \u00f6ng\u00f6r\u00fclm\u00fc\u015f olup, bu d\u00fczenleme referandum sonucunda kabul edilmi\u015ftir. Bu de\u011fi\u015fikliklerden birisi de, kamu g\u00f6revlileri sendikalar\u0131na toplu s\u00f6zle\u015fme hakk\u0131n\u0131n tan\u0131nmas\u0131d\u0131r. <\/p>\n<p>Nitekim, 5982 say\u0131l\u0131 yasan\u0131n 6.maddesi ile, TC.Anayasas\u0131\u2019n\u0131n 53.maddesinin kenar ba\u015fl\u0131\u011f\u0131 \u201cA.Toplu i\u015f S\u00f6zle\u015fmesi ve toplu s\u00f6zle\u015fme hakk\u0131\u201d olarak de\u011fi\u015ftirilmi\u015f ve maddenin \u00fc\u00e7 ve d\u00f6rd\u00fcnc\u00fc f\u0131kralar\u0131 y\u00fcr\u00fcrl\u00fckten kald\u0131r\u0131lm\u0131\u015ft\u0131r. Y\u00fcr\u00fcl\u00fckten kald\u0131r\u0131lan 3.f\u0131krada,<br \/>\n128 inci maddenin ilk f\u0131kras\u0131 kapsam\u0131na giren kamu g\u00f6revlilerinin kanunla kendi aralar\u0131nda kurmalar\u0131na cevaz verilecek olan ve bu maddenin birinci ve ikinci f\u0131kralar\u0131 ile 54 \u00fcnc\u00fc madde h\u00fck\u00fcmlerine tabi olmayan sendikalar ile \u00fcst kurulu\u015flar, \u00fcyeleri ad\u0131na yarg\u0131 mercilerine ba\u015fvurabilir ve idareyle ama\u00e7lar\u0131 do\u011frultusunda toplu g\u00f6r\u00fc\u015fme yapabilirler. ..h\u00fckm\u00fc yer almaktad\u0131r.<\/p>\n<p>Kald\u0131r\u0131lan h\u00fck\u00fcmde, Sendikalar\u0131n, \u201c\u00fcyeleri ad\u0131na yarg\u0131 mercilerine ba\u015fvurma\u201d hakk\u0131n\u0131n da yer almas\u0131, de\u011fi\u015fiklikten sonra Sendikalar \u00fcyeleri ad\u0131na dava a\u00e7amayacak m\u0131, sorusunu g\u00fcndeme getirmi\u015ftir. <\/p>\n<p>\u00d6ncelikle belirtmek gerekir ki, \u00f6rg\u00fctlenme hakk\u0131n\u0131n, yani Sendika kurma hakk\u0131n\u0131n tan\u0131nmas\u0131, kendili\u011finden, bir dizi temel hakk\u0131 da beraberinde getirmektedir. \u00d6rg\u00fctlenme hakk\u0131n\u0131n tan\u0131nmas\u0131, sadece Sendika tabelas\u0131n\u0131n as\u0131labilmesi anlam\u0131na gelmez, bu hakk\u0131n \u00f6z\u00fcn\u00fc olu\u015fturan, olmaz ise olmaz\u0131 olan yetki ve faaliyetlerin de tan\u0131nmas\u0131 gerekir. Sendikan\u0131n, \u00fcyesi ad\u0131na dava a\u00e7ma\/hukuki temsil hakk\u0131n\u0131 kullanmas\u0131 da bu yetkilerden birisidir. <\/p>\n<p>Anayasalar, temel metinler olarak, ayr\u0131nt\u0131l\u0131 d\u00fczenlemeler i\u00e7ermemelidir. Hakk\u0131n tan\u0131nmas\u0131, \u00f6z\u00fcn\u00fcn ortaya konulmas\u0131 ile uygulamaya dair d\u00fczenlemelerin yasalar ile yap\u0131lmas\u0131 esast\u0131r. Ayr\u0131ca, hak ve \u00f6zg\u00fcrl\u00fckler a\u00e7\u0131s\u0131ndan, yasaklanmayan faaliyet\/yetkilerin varl\u0131\u011f\u0131n\u0131n kabul\u00fc temel yakla\u015f\u0131md\u0131r.<\/p>\n<p>Nitekim, Anayasan\u0131n 51.maddesi \u201csendika kurma hakk\u0131\u201dn\u0131 i\u00e7ermekte ve gerek i\u015f\u00e7i sendikalar\u0131 gerekse de kamu g\u00f6revlileri sendikalar\u0131n\u0131n bu haklar\u0131n\u0131 kullanmalar\u0131na dair usul ve esaslar\u0131n yasayla d\u00fczenlenece\u011fi kabul edilmi\u015ftir. <\/p>\n<p>Bu h\u00fck\u00fcm do\u011frultusunda, i\u015f\u00e7i sendikalar\u0131 i\u00e7in 2821 say\u0131l\u0131 Sendikalar Yasas\u0131 kabul edilmi\u015f ve yasan\u0131n &#8220;Sendikalar\u0131n \u00e7al\u0131\u015fma hayat\u0131na ili\u015fkin faaliyetleri&#8221; ba\u015fl\u0131kl\u0131 32&#8217;nci maddesinin 3&#8217;\u00fcnc\u00fc bendinde, sendikalar\u0131n \u00e7al\u0131\u015fma hayat\u0131ndan, mevzuattan, toplu i\u015f s\u00f6zle\u015fmesinden, \u00f6rf ve adetten do\u011fan hususlarda i\u015f\u00e7ileri ve i\u015fverenleri temsilen veya yaz\u0131l\u0131 ba\u015fvurular\u0131 \u00fczerine, nakliye, ne\u015fir veya adi \u015firket mukaveleleri ile hizmet akdinden do\u011fan haklar\u0131 ve sigorta haklar\u0131nda \u00fcyelerini ve miras\u00e7\u0131lar\u0131n\u0131 temsilen davaya ve bu m\u00fcnasebetle a\u00e7t\u0131\u011f\u0131 davadan \u00f6t\u00fcr\u00fc husumete ehil olabilecekleri kurala ba\u011flanm\u0131\u015ft\u0131r.<\/p>\n<p>Ayn\u0131 \u015fekilde, kamu g\u00f6revlilerinin kurduklar\u0131 sendikalar ile ilgili 4688 say\u0131l\u0131 yasa kabul edilmi\u015f ve bu yasan\u0131n 19&#8217;uncu maddesinin (f) f\u0131kras\u0131nda yer alan, &#8220;\u00dcyelerin idare ile do\u011facak ihtilaflar\u0131nda, ortak hak ve menfaatlerinin izlenmesinde veya hukuki yard\u0131m gereklili\u011finin ortaya \u00e7\u0131kmas\u0131 durumunda \u00fcyelerini veya miras\u00e7\u0131lar\u0131n\u0131, her d\u00fczeyde ve derecede y\u00f6netim ve yarg\u0131 organlar\u0131 \u00f6n\u00fcnde temsil etmek veya ettirmek, dava a\u00e7mak ve bu nedenle a\u00e7\u0131lan davalarda taraf olmak&#8221; h\u00fckm\u00fc ile Sendikalar\u0131n \u00fcyeleri ad\u0131na dava a\u00e7\u0131p takip edebilecekler, a\u00e7\u0131k\u00e7a d\u00fczenlenmi\u015ftir.<\/p>\n<p>Sendika kurma hakk\u0131n\u0131n \u00f6z\u00fcn\u00fc olu\u015fturan, Sendikalar\u0131n, \u00fcyelerinin istek ve verdikleri yetki do\u011frultusunda, \u00fcyeleri ad\u0131na dava a\u00e7ma\/takip etme yetkisinin, Anayasan\u0131n 53 \u00fcnc\u00fc maddesinin (3) nolu f\u0131kras\u0131n\u0131n kald\u0131r\u0131lmas\u0131yla ortadan kalkmas\u0131 m\u00fcmk\u00fcn de\u011fildir.
